Internet Filters: Voluntary OK, Not Government Mandate

People are talking about internet content filtering, especially since the ACLU won its case against the Child Online Protection Act (COPA), which tried to censor all speech about sex from the internet. But don’t be confused between voluntary use of filters as an alternative to a criminal statute and governmentally imposed filters. ACLU First Amendment attorney Chris Hansen explains more about filtering and when it works and doesn’t.

Filtering has been shown to be quite successful in blocking sexual sites, but at a price — it over-blocks. As much as 20 percent of all internet content can be over-blocked by some filters, including valuable nonsexual material. Reports by the Kaiser Family Foundation (PDF), Consumer Reports, and the Free Expression Policy Project (PDF) have all found that filters improperly block important web sites about health, sex education, civil rights, and politics. A recent test by the San Jose Public Library (PDF) of three software filtering programs even found substantial over-blocking of information in resource databases and online catalogs of available books. Parents can decide that price is worth paying but it is another thing altogether for the government to make that decision for all of us.

   EVIDENCE OF PRIOR RESTRAINT AND CENSORSHIP OF INTERNET POLITICAL SPEECH, APPARENTLY BY GOVERNMENT SURVEILLANCE PROGRAMS

   When this writer, a journalist who has been an apparent "target" of pervasive government spying and "programs of personal destruction, attempts to make posts to The Philadelphia Inquirer and some other sites, he gets an on-screen message that the post is being "reviewed for publication."

   Usually, the post never appears. Yet posts from other readers invariably are posted immediately. So what's going on?

   My experience seems to indicate that a sophisticated third party is intercepting my internet communications by way of the insertion of fake, "spoofed pages" and real-time "mirroring" of my account -- apparently allowing prior restraint and censorship of my internet communications.

   It used to be that only posts that could be interpreted as critical of the Bush-Cheney administration were subject to interception. Now, it seems that ALL of my attempted posts to the Philadelphia Inquirer's Dick Polman blog are "reviewed" indefinitely, never to post.

   I believe The Philadelphia Inquirer has no idea that their pages apparently are being "spoofed" by over-reaching government spies. If you have contacts at the paper, please email them this column, because MY email is apparently subject to the same kind of prior restraint and interception.

   Of course, now that I write this, my apparent censors may relent and post the comment that I attempted to make to the Inquirer's political blog earlier today.

   I have written extensively about this apparent government censorship. I am looking for a civil liberties organization to file a class action suit on behalf of all affected Americans, which I believe number in the many thousands.

   DIGITAL TV SWITCH OPENS ELECTRONIC DOOR TO CENSORS - AND SPIES?

   • "Addressable" remote technology allows would-be "big brothers" to block channels, or programs, from certain viewers.

   • A way to control authorized viewing -- or to censor and harass "targeted" persons by messing up their signal?

   • Electronic surveillance built into the algorithm?

   Lost amid the hype surrounding the transition to digital television is the fact that DTV technology is addressable. That is, each HDTV or DTV converter box only will receive channels that have been previously scanned in. But here's what's not widely known, and rarely discussed:

   DTV technology provides an electronic means to selectively control the programming available to each set or converter box. The most frequently cited reason is a need to regulate access to proprietary programming available by subscription only, or to prevent home recording of copyrighted material such as recently released movies.

   But the technology also allows a would-be censor to block channels, or programs, from certain groups of viewers, or from the entire audience.

   And, of course, DTV will be mandatory once traditional analog signals are taken down for good. Congress, at the request of the Obama administration, has pushed the date back to June 12 of this year out of concern that millions of American TV households wouldn't have been ready in time for the previous DTV deadline of February 17th.

   But the technology also raises the specter of what might be termed "rogue censorship" perpetrated by technically savvy video saboteurs equipped with a remote control device and the DTV address of "targeted" viewers.

   And how would a "big brother" know the "address" of each set, or box? Easy! The DTV boxes are being subsidized by government coupons, so the government is collecting a huge database of DTV addresses. As for buyers of high-definition or standard-definition digital sets, would-be TV censors could demand customer data under the provisions of sweeping laws such as the USA Patriot Act (unless, that is, if Congress restores civil liberties in America by scaling back the law's draconian provisions).

   Rogue government agents or private sector video vandals who dare to violate constitutionally-protected rights by using DTV technology as a tool of psychological harassment and control wouldn't necessarily need the precise "address" in advance. A technically sophisticated oepration could decrypt the access key just by being in proximity to the set or converter box. That's because each set or box (or computer, for that matter) radiates an electronic field that can be accessed by hi-tech equipment in possession of spy outfits such as the National Security Agency -- providing another possible gateway to remote manipulation of the DTV datastream.

   Tekkies long have known that DTV specs require a so-called "broadcast flag" to prevent unauthorized recording or reception of programming to unauthorized viewers. That same built-in screening technology is what opens the door to potential censorship of broadcast TV programming.

   To be more specific, DTV's addressability features allow certain channels to be blocked; reception can be degraded (pixelization -- blocking and streaking -- or a sudden "fade to black"); or, perhaps, an alternate message could be broadcast to "targeted" users, what would be a chilling echo of that old Apple Macintosh "Big Brother" commercial.

   Now here's the really intriguing part: Some tekkies insist that the DTV technology could be used to turn any DTV set or set-top converter box into an electronic eavesdropping "bug" -- using the connection to the set's speakers as pre-installed microphones.

   Ele ctronically, turning DTV into an audio surveillance device would be a simple task. But is that capability really built into consumer units? If electronics industry or government insiders know, they aren't telling.

   Some spy hypothesizers speculate that pinhole video cameras may be built into sets and boxes; while plausible, the assignation of DTV as an in-home video voyeur remains just that -- speculation.

   DTV addressability, however, is very real. Victims of so-called "organized community gang-stalking" by citizen vigilantes affiliated with government-sponsored community watch, policing, and anti-terrorism groups say that harassers (or perhaps, operatives who serve as their handlers) already are randomly disrupting the DTV reception of their "targets" as a malicious method of psychological intimidation -- what might be termed "video psy ops."

   That's not merely speculation; I believe that has happened to this journalist, and to other "targets" of covert surveillance and "programs of personal destruction" created or expanded during the Bush-Cheney years. Is it just coincidence that the DTV specs were formulated during the first five years of the Bush era?

   As Special Agent Jethro Gibbs of TV's N.C.I.S. is wont to say: "I don't believe in coincidences."

   Addendum to post, above:

   Since writing extensively about DTV and advocating a delay in the shut-off of analog signals to give the public more time to get ready, my recent attempts to post to Broadcasting & Cable magazine, the "bible" of the industry, have been unsuccessful.

   I believe this is another example of over-reaching by government spies who have targeted American journalists.

   Since writing the above post referencing the Phila. Inquirer, my post to Dick Polman's political blog suddenly appeared today -- a full day after my attempt to post the comment.

   The people who are apparently infringing upon my constitutional rights back off when publicly exposed, then revert to their authoritarian ways shortly thereafter. These people think they are above the law. Only a class action lawsuit will effect change. It appears to me that a change of administration in Washington won't do it alone.

   I, for one, would be willing to donate a third of any subsequent financial award to ACLU in consideration of its advocacy. Perhaps such a policy would help relieve ACLU of its financial burdens.

   I believe the reference to a "Multi-Agency Action Center" established during the Bush administration is the reason the censors do not want this post published.

   (The apparent censors also frequently insert typos and other misinformation into posts that do go through -- an apparent attempt to make the writer appear to be uneducated or sloppy.)

   As written in this space previously, the Washington Post does NOT "hold" blog posts. It is my understanding that only the use of foul language triggers its filtering software.

   It appears that ALL of my political speech is subject to prior restraint and censorship by government censors. I believe this is emanating from the "Fusion Center" that is located in Newtown, PA, just a few miles from my home.

   Again I appeal to the ACLU: PLEASE FILE A CLASS-ACTION LAWSUIT on behalf of me and others similarly affected by pervasive government surveillance and censorship.

    Sixth addendum re: APPARENT GOVERNMENT PRIOR RESTRAINT AND CENSORSHIP OF INTERNET POLITICAL SPEECH

    Just attempted to post a comment to the American Constitution Society blog.

    After a L-O-N-G pause, I received a message stating that because I was a "first-time" poster, my comment was being held for review.

    ONE PROBLEM: I have posted there multiple times before, and the "cookies" I left on the ACS computer should have reflected that I had posted before.

    CONCLUSION: Quite possibly, government censors at the various "fusion centers" across the U.S. create "spoofed pages" of blog moderation pages, and use the moderation "pretext" as a means to exercise prior restraint and/or censorship of internet communications.

    RECOMMENDATION TO WEBMASTERS: To ensure free speech on the net, moderate blogs only AFTER submissions are posted.

    That way, you can ensure that rogue censors are not using spoofed pages as a means to exercise censorship upon those who are unconstitutionally "targeted" by draconian government surveillance programs sold to Congress as part of the "war on terror" -- but used to censor American citizens who dare to exercise their free speech rights.

    SIXTH Addendum in this running commentary on apparent government censorship/prior restraint of internet political speech

    This evening, I attempted to post the following comment to an item about an address by Vice President Biden that appeared on The Washington Post's "44" political blog. The post did not go through. Instead, I received a "Comment Submission Error" message stating that "too many comments" have been "submitted from (sic) you in too short a time."

    Fact is, that was the first time this evening that I had attempted to submit a comment to the "44" blog.

    I believe this is another example of prior restraint and censorship on my political speech. I believe it emanates from a Homeland Security "fusion center" in Newtown, PA, a few miles from my home. My electronic communications are continuously interfered with, 24/7. This apparent malicious, sadistic and unconstitutional violation of my rights has made it difficult for me to pursue my career as a journalist.

    This "diary" will serve as a contemporaneous record when I file a legal action against the government in regard to this issue -- hopefully, with the aid of the ACLU.

    Here is the comment that would not post. Its content gives hint as to what subjects trigger apparent government prior restraint and/or censorship:

    "VP BIDEN: A significant address that clearly sets the moral compass for U.S. foreign policy.

    NOW TEAM OBAMA MUST ACT TO BAN RADIATION WEAPONRY (A/K/A "DIRECTED ENERGY WEAPONS")...

    ... WIDELY DEPLOYED TO U.S. SECURITY/INTEL OPERATIVES, AND NOW, TO LOCAL LAW ENFORCEMENT.

    SEVENTH ADDENDUM to all the above:

    Moments after posting the above entry, I returned to The Washington Post's "44" blog to see what effect, if any, posting here to the ACLU blog would have on the operatives who apparently are monitoring my internet connection in real time, equipped with software that apparently allows them to insert "spoofed pages" into my data stream and remote computing software that allows the hijacking of my computer functions.

    As has happened in the past, the post that apparently was subject to prior restraint about an hour ago was up and posted on the "44" political blog site -- stamped with the time that I attempted to make the post, which, as mentioned above, was not immediately posted to the site as is routine.

    I strongly believe the fact that I made these entries here led my apparent censors to put the original post through. This cat-and-mouse game amounts to psychological harassment -- another charge that I will make in my lawsuit, in addition to prior restraint and censorship on First and Fourth Amendment grounds.

    Thank you, ACLU, for providing a forum that, however inelegantly, gives the authoritarians at least SOME pause as they continue their apparent assault on our constitutional rights.

    But a class-action lawsuit is needed to end these draconian programs once and for all.

    But the more urgent issue is the proliferation of silent, injury- and illness-inducing, potentially deadly radiation weaponry -- an issue the ACLU is yet to address.

    This contemporaneous record is intended for ACLU attorneys and bona fide civil libertarians... not paid trolls, or the perpetrators of these ongoing violations of constitutionally-protected civil liberties.

    Mr. Hansen:

    As I have discussed above, I am an apparent "target" of pervasive government surveillance, malicious interference and tampering with my telecommunications.

    This continues to this very moment. It appears that my connection is monitored and mirrored in real-life. The functions of my computer are hijacked almost continually, via remote computing software and "spoofed pages." This interference, let alone the surveillance, has made it virtually impossible for me to communicate effectively. As a journalist, this malicious interference has seriously impaired my career.

    Not only is my political speech subject to prior restraint and censorship, as outlined above; I am being prevented from posting to some sites vital to my career, such as broadcastingandcable.com, politico.com and propublica.com.

    I believe this malicious surveillance and tampering is emanating from a fusion center in Newtown, PA, not far from my home. This has been going on for five years running. Only recently have my posts to ACLU been allowed to go through. I attribute that to my persistent attempts to secure justice as an unjustly "targeted individual," to use the Big Brother parlance.

    There is no justification or probable cause for the abuses of power to which I have been subjected.

    Please, sir, tell me what I can do. My I meet with you at your offices to discuss possible legal remedies -- not just for me, but for the thousands of others in my "affected class"?     Mr. Hansen: I received a phone call this morning from someone who identified himself as you. I asked the person if he had read my threads on this blog. He said he only saw my message to him (which I thought was strange, since a forwarded link would contain this whole page).

    I suggested he read my posts, and he said to call back.

    I returned the call (to an ACLU extension number) and requested a person meeting with the person who identified himself as Chris Hansen.

    I explained that because I believe I am subject to unconstitutinal 24/7 electronic surveillance, I did not feel comfortable speaking on the phone.

    He said he would have to talk to me on the phone to assess the need for an in-person meeting. When I demurred, he insisted. He was less than empathetic to my privacy concerns about a telephone conversation.

    Finally, this alleged "Chris Hansen" said: "I think we've reached an impasse."

    I expressed the view that I thought he reponses were not what I would have expected from a civil liberties attorney.

    He wished he luck.

    Sir, if that was NOT you on the line, then you can see why I need this meeting.

    If that was you on the line, I am befuddled. But my 35 years as a journalist tell me that I may not have been speaking to the "real" Chris Hansen.

    Could you please post me a note here, so I can verify on an outside computer that the refusal to allow me to stop by in person did indeed come from an ACLU attorney and not from one of the rogue agents who have destroyed my career?

    This morning I attempted to post the following political commentary to The Washington Post's "The Fix" political blog. After I send the "send" button, the browser task bar suddenly showed a "stopped" message, although I did not hit the "stop" button on the browser.

    After a delay, I received the now-familiar message that the post was "received and is being held for the blog owner."

    As I have written here before, this message almost certainly did NOT come from WaPo, since the paper's blog software does not "hold" posts unless foul language is used.

    The evidence indicates that this is yet another case of prior restraint and censorship. As I wrote yesterday, it appears that someone may have telephoned me, posing as Chris Hansen of ACLU, refusing my request to talk in person rather than over the (apparently wiretapped) telephone.

    So once again, I post here the message that SOMEONE apparently does not want the public to see. Once again, I ask the ACLU to use these incidents as the basis for a renewed legal challenge to government surveillance policies:

    Now ALL of my attempts this morning to post to the political blog "The Fix" at washingtonpost.com are met with the "being held for blog owner" message that I believe is NOT emanating from The Washington Post (a simple inquiry to a trusted, known source at the newspaper could confirm this).

    THIS APPARENT DRACONIAN CENSORSHIP CANNOT BE ALLOWED TO STAND.

    ACLU, if this is happening to this journalist, it can (and, most likely, is) happening to many, many other Americans.

    Dear Sen. Leahy:

    I read about your petition drive for a "truth and reconciliation commission" to investigate possible constitutional and criminal abuses of power by the Bush administration -- including the Bush Justice Department's apparent approval and funding of the use of radiation weaponry on U.S. citizens "targeted" by certain government agencies.

    When I tried to access the site "Bushtruthcommission.com" I was taken to a sign-in page for "ga3.org" that asked for a user name and password. There was no information as to how to sign up -- effectively preventing me from petitioning for redress of grievances, which is, of course, a constitutional right.

    I believe this may have been a so-called "spoofed page," inserted into my data stream win real time by a government surveillance "fusion center" operation.

    As a longtime journalist, I believe I have been subject to unconstitutional surveillance, and much worse. I have written extensively about this at My.NowPublic.com/scrivener.

    If there is not a sign-in to access your petition, then I believe some powerful entity is interfering with your ability to communicate with the public, an infringement upon YOUR rights as well as mine.

    Great to hear from you. I tried posting web form messages to Sen. Leahy, several months ago, and last week as well.

    I have gotten no response.

    I have emailed dozens of members of the Senate and House Judiciary Committees, via their web forms on their government web sites.

    I have gotten NOT ONE SINGLE RESPONSE.

    I have been subject to what I believe is draconian government surveillance, malicious and sadistic tampering and interference with my internet AND telephonic communications. I have written about these issues here, as well as on my web site.

    If this can happen to this journalist (whose career was derailed five years ago by my apparent unjust "targeting" by what I believe is a coordinated array of "programs of personal destruction"), it can, and IS, happening to thousands of other Americans.

    That is why I ask the ACLU to file a class-action lawsuit on behalf of classes of persons widely targeted by government surveillance -- i.e., journalists. This is a different set of facts than those presented in the previous ACLU lawsuit against NSA warrantless spying.

    If ACLU solicited journalists to submit anecdotal evidence of government surveillance, tampering and censorship, as I have done, I believe there would be a strong basis for such a class-action lawsuit.

    It is interesting that correspondent James Riesen of the New York Times has reported similar concerns in a televised interview with Keith Olbermann on MSNBC in the wake of the disclosures made by former NSA analyst Russsell Tice -- but he has not followed up with his own story in The Times.

    Could that be because Mr. Tice has been slandered by officials, keeping the mainstream media away from the story? I believe that same phenomenon may have happened in my case. I also have been threatened with bodily harm in public web posts. Suzanne, this is "terrorism, American-style."

    What I believe are unconstitutional and malicious actions by government on the federal and local levels (i.e., regional "fusion centers") have derailed my career and have decimated my finances and family. I would like to seek monetary damages by way of a class-action lawsuit, and would be willing to to the ACLU third of any personal award in appreciation of taking up this cause of free speech.

    I'd also like to meet personally with you and ACLU staff; given my concerns over privacy matters, I do not think that is an unreasonable request (see posts above).

    It is becoming apparent that the most persistent prior restraint and censorship of my political posts happens when I attempt to transmit by web form a comment to Philadelphia-area media web sites -- most notably, The Philadelphia Inquirer.

    This latest example was an innocuous commentary on Dick Polman's column about a New York Times story involving John McCain and a Washington lobbyist. Not very controversial -- but then I made an analogy to some articles that a powerful entity apparently does not want Philadelphia-area media and/or residents to read.

    This prior restraint tells me that the unconstitutional operators most fear being exposed by Philadelphia media... because that region apparently is the region in which these rogue actors are based.

    Please, readers, email this ACLU page link to dpolman@phillynews.com. As mentioned before, my email is subject to interception so I cannot rely on doing it myself.

    The latest insult to free speech on the internet:

    While writing a commentary on my internet blog site, My.NowPublic.com/scrivener, I urged Attorney General Holder to take immediate action to end Bush-approved microwave radiation weapons assaults on "innocent but targeted" U.S. citizens.

    When I tried to copy the entry -- just in case it should disappear when I hit the "send" button, as has happened many times before -- the copy function within my web browser became disabled.

    I tried to "drag and drop" the comment to a text program; but that function, too, was disabled, denying me any means of copying the post.

    This is apparently being accomplished by third-party remote computing software and an unauthorized (by me) "network" connection that appears on my desktop at startup.

    I believe this is another example of malicious, sadistic internet tampering and interference -- and issue that to date has not been addressed by the ACLU, even though my experiences indicate that such malicious interference is part and parcel of the government's warrantless surveillance program.

    Please, ACLU, realize that the telecommunications system is apparently being used as a tool of government intimidation and harassment. Only a class-action lawsuit can hope to cure this ill.

    I intended to post the comment here to memorialize it, but since the copy function in my browser was disabled, I am unable to do so.

    If history is an indicator, once I send this post to the ACLU blog, I may find that the copy function in my browser again is restored. But maybe not.

    This is harassment, pure and simple, an apparent component of unconstitutional government surveillance of telecommunications in America 2009.

    This correspondent is unable to get his comments to CQPolitics.com to post. It appears that a government surveillance program is inserting "spoofed pages" that require a sign-in to post a comment -- when in the past, the site's blog sections also have accepted comments from non-registered readers.

    Even when this writer complies with the sign-in demand, and a requirement to "share" his email address, all of his recent posts have been elicited a "held for blog owner" message -- and none of his recent comments have been posted as of this time.

    This writer also has been blocked from posting comments to Broadcastingandcable.com, where he was a frequent contributor advocating a delay in the digital TV transition. His recent attempts to post comments have elicited a "wrong email address" message, even though no email address is required to post.

    And this writer has been blocked from posting comments to full articles at Politico.com, after having published commentary about extrajudicial punishment and other controversial topics.

    A reading of the comments posted to this thread, supra, reveal a pattern of prior restraint and outright censorship that the author believes is a purposeful product of unconstitutional government surveillance programs. This apparent censorship also involves the use of the telecommunications system as a tool of harassment, through the apparent use of real-time site mirroring and third-party remote computing software that "hijacks" the user's computer -- slowing down or disabling functions, making it difficult and sometimes impossible to effectively communicate.

    For a protracted period, comments to the ACLU site also failed to post; the writer's persistent complaints apparently caused government surveillance censors to relent in the case of posts to this site.

    Again this writer asks the ACLU to intervene on the behalf of similarly affected persons with a class-action lawsuit challenging the government's surveillance programs and what appears to be an institutionalized campaign of telecommunications-based prior restraint, censorship and harassment.

    When I tried to sign in, I got the message that my account was still "deactivated." But the system still let me into the article comment web form, which also allowed me to enter my commentary.

    BUT WHEN I HIT THE SUBMIT BUTTON THE FUNCTION WAS DISABLED. THE SUBMIT LINK WAS "DEAD."

    I can't get a straight answer from Politico.com; my emails asking why I am still banned are not answered. (A voice on the phone had told me it was because I made duplicate posts to multiple threads, something posters do all the time at Politico, with apparent impunity.)

    BUT THE NON-RESPONSE MAY NOT BE POLITICO'S DOING.

    Because it appears most of my email is being intercepted. Most of my outgoing email do not bring a response.

    The fact that I am prohibited from posting to multiple web sites, including some of those that are vital to my ability to function as a journalist, tells me that free speech is virtually dead in America.

    HERE IS THE CENSORED POST:

    I'm the author of the posted article. Very interesting to read the comments here -- a number of which read like actual, legitimate comments as opposed to what is deposited on my blog site, where most comments read like lame, often sadistic psy ops (but with some valuable kernels of truth offered by closet humanists).

    This is not some private enterprise, although private companies are involved, as in any fascist organization where government co-opts private businesses to gain societal control. This extrajudicial punishment network is a "multi-agency action" of various agencies. I agree with some others, such as Peter Mooring in the Netherlands, that among the "lead agencies" worldwide are armed forces, intel agencies, law enforcement and at the top of the food chain secretive security services. This is a global control mechanism accountable to no public body -- with serious geopolitical ramifications for human liberty.

    The mainstream media from which I spring does not have a clue that global military, security and intelligence agencies appear to have taken over the world by way of these secretive "programs, employing silent, deadly microwave radiation weaponry to quell potential "dissent."     Attention American Constitution Society staff:

    My experience indicates that rogue government surveillance agents are using "spoofed pages" to prevent innocent but "targeted" U.S. citizens from making posts to your web site.

    On two recent occasions, this writer has received the "held for blog owner" message, which notes that this feature is reserved for "first-time" posters.

    However, I have successfully posted before.

    I believe the CONTENT of my comments determines whether government fusion center operatives allow the post.

    The incidents outlined above seem to indicate that the government is exercising prior restraint and censorship of internet telecommunications, especially in the case of political speech.

    I would suggest that ACS exercise ex post facto moderation of its blog, to thwart attempts by rogue surveillance operatives to use moderation as a pretext for censorship.

    ACS members: Please forward the link to this page to your executives. As explained above, my ability to do so apparently is persistently circumscribed.
