Let Eileen Vote.

By Nicole Kief, ACLU & Robert Doody, ACLU of South Dakota at 5:04pm

What’s new in voter suppression land today? South Dakota is trying to prevent Eileen Janis — and hundreds of other citizens — from voting.

Eileen grew up on the Pine Ridge Indian Reservation and does suicide prevention work. She registered to vote for the first time in 1984. “I always vote because my mom told me to,” she says.

We'll See You in Court: South Dakota's Governor Signs Outrageous Law Restricting Abortion Care

By & & Brigitte Amiri, ACLU Reproductive Freedom Project & Robert Doody, ACLU of South Dakota at 3:11pm

Today, South Dakota's governor, Dennis Daugaard, signed a bill that creates unprecedented restrictions on access to abortion care. As we've blogged before, this law requires women to wait 72 hours between the first counseling session with the doctor and the abortion; it also requires women to first visit "crisis pregnancy centers," entities that are notorious for providing false and misleading information; and requires doctors to tell the woman of any possible risk factor published in medical and psychological journals since 1972. These new restrictions are on top of the long list of abortion restrictions in South Dakota, and come from a state that has one abortion provider.

Enough Is Enough: The Latest South Dakota Attack on Women’s Access to Abortion Goes Too Far

By & & Brigitte Amiri, ACLU Reproductive Freedom Project & Robert Doody, ACLU of South Dakota at 1:04pm

Recently, an extreme bill sailed through the South Dakota legislature, which places unprecedented restrictions on access to abortion care. This bill requires women to wait 72 hours between the first counseling session with the doctor and the abortion; it also requires women to first visit “crisis pregnancy centers,” entities that are notorious for providing false and misleading information; and requires doctors to tell the woman of any possible risk factor published in medical and psychological journals since 1972. These new restrictions are on top of the long list of abortion restrictions in South Dakota, and they also come from a state that tried to ban abortion outright twice in the last few years. These new attempts to restrict abortion are outrageous attempts to deny women basic health care services, and to shame and humiliate them. Enough is enough.

"They Treat Us Just Like Guinea Pigs."

By Alexa Kolbi-Molinas, ACLU Reproductive Freedom Project & Robert Doody, ACLU of South Dakota at 2:10pm

"They treat us just like guinea pigs when it comes to Indian Health Services." That's how one woman on the Cheyenne River Sioux reservation described the birth of her second child. She is not alone. Today, the ACLU and the ACLU of South Dakota filed a Freedom of Information of Act (FOIA) lawsuit against Indian Health Services (IHS), seeking information about the provision of reproductive health care services to the women of the Cheyenne River Sioux.

Sovereign Women Build Sovereign Nations

In the past few weeks, we at the ACLU have been able to rejoice over several provisions of a recent piece of legislation signed into law on July 28 by President Obama. The Tribal Law and Order Act of 2010 dedicates additional resources and grants additional powers to American Indian tribes throughout the country to combat the serious crisis of sexual assault and domestic violence against American Indian women. The act expands training programs for tribal officers on how to interview sexual assault victims and provides for additional training on evidence collection so that more convictions for sexual assault can occur. The new act also allows for greater collaboration between Indian Health Services and the Department of Justice on standardized protocols for how to handle and work with sexual assault victims.

Who You Love Shouldn't Matter When You Serve

Jene Newsome served nine years in the Air Force. She was recently discharged under the "Don't Ask, Don't Tell" policy after she was outed by South Dakota's Rapid City Police Department.

On November 20, 2009, the Rapid City Police Department came to serve a warrant on Jene Newsome's wife. Jene and her wife, Cheryl, were just married in Iowa a few weeks before the police came knocking on their door.

Schoolyard Equality in Rapid City

By Robert Doody, ACLU of South Dakota at 5:19pm

The year 2009 was a whirlwind for the ACLU of South Dakota and one of our major projects is moving forward at exceptional speed. Last year, the ACLU of South Dakota began work with Equality South Dakota on the "Workplace Fairness Project," a grassroots approach to address anti-LGBT discrimination. The ultimate goal is to amend the South Dakota Human Rights Act to add sexual orientation and gender identity to already existing discrimination protections. It was a long year, a hard year with a few major victories, but a lot of setbacks, and sometimes you had to wonder: "Is this worth it?"

With word that MSNBC has called defeat for the South Dakota abortion ban, mouths are open and shouts are heard throughout the gathering of reproductive rights supporters here in Sioux Falls. Victory is coming soon...for the second time an abortion ban will be defeated in this state. This is a great night for the women and families of

Standing on the Precipice of Success for Abortion Rights

By Robert Doody, ACLU of South Dakota at 10:41pm
Smiles are big and hopes are high here in South Dakota with the first numbers of 55 percent NO and 45 percent YES. With these early results,  the optimism of the campaign to defeat the abortion ban has proven to be correct.  We are hopeful that we're standing on the precipice of another clear democratic mandate for access to reprodu
