9/11's Legacy of Religious Discrimination

It's no secret that, after 9/11, a wave of anti-Muslim bigotry washed over the country. The intensity of that prejudice has sustained it for a decade, and, in many ways, anti-Muslim sentiment and fear of Islam seem even stronger and more deeply rooted today than in the months and years after the attack. In the last few years, for instance, a number Muslims or people perceived to be Muslims have been violently assaulted; and scores of mosques and Islamic Centers have been vandalized, with attacks ranging from racist and anti-Muslim graffiti to arson and firebombing.

Protecting and Serving All, Regardless of Faith

As a former police chief of numerous Oklahoma towns, including Seminole, Clinton, Blackwell, Owasso, Bethany, and Chickasha, I have seen officers disciplined for a variety of insubordinate acts. During my 35 years in law enforcement, however, I have never had to discipline an officer for refusing to carry out an assignment because he objects to the faith of the individuals he has been ordered to serve. Indeed, no officer serving under me has claimed that right because every law enforcement official knows that refusing orders on these grounds would not only amount to insubordination, but would also violate the oath sworn by all officers to uphold the U.S. Constitution. That oath requires that as, police officials, we serve and protect all members of the community, regardless of faith or belief.

Guantánamo Prisoner's Memoirs Offer Rare First-Person Account of Torture

A detailed and harrowing first-person narrative of a prisoner's experiences in Guantánamo is available to the public for the first time: Slate today published a three-part series of excerpts from The Guantánamo Memoirs of Mohamedou Ould Slahi. The excerpts were culled from a manuscript hundreds of pages in length, which Slahi provided his attorneys, a pro bono team of ACLU and other lawyers. After being classified for years, Slahi's memoirs – of arrest, rendition, torture, and imprisonment without charge or trial – are finally seeing the light of day, albeit with some redactions.

Paying the Price for Defending Religious Freedom in South Carolina

"What's the harm?" That is the question we are often asked when the ACLU steps in to stop public school officials from including official prayer in school events and proselytizing students. It was a question posed by many community members in the Chesterfield County School District when we filed a lawsuit on behalf of middle school student Jordan Anderson after the district invited Christian rapper B-SHOC and a youth minister to evangelize students during a school-day assembly and continued to subject to students to a variety of other religious practices.

God's Gospel Lizards: Creationist Group to Educate Kansas Public School Students on the "Truth About Dinosaurs"

Students at Hugoton High School in Hugoton, Kansas, are set to finally learn the “truth about dinosaurs” next week—at least the truth as the Creation Truth Foundation sees it. The religious organization, which advocates for “a return to all of [the] realities of Biblical Creation,” is scheduled to conduct several mandatory school-day assemblies about dinosaurs for all students and teachers on Tuesday. The ACLU of Kansas & Western Missouri and the ACLU Program on Freedom of Religion and Belief learned about the planned assembly yesterday afternoon and sent a letter today demanding that the public school district cancel the event.

Businesses Do Not Have a License to Discriminate

Yesterday, the ACLU and the ACLU of New Mexico filed an amicus brief in Elane Photography, LLC v. Willock, an important antidiscrimination case pending before the New Mexico Supreme Court. Elane Photography is a wedding photography studio that advertises its services to the general public but refuses to take pictures for wedding or commitment ceremonies involving same-sex couples. New Mexico is one of 21 states (plus the District of Columbia) that prohibit businesses who hold themselves out to the general public from discriminating against customers based on their sexual orientation. But Elane Photography argues that the law cannot be applied to its services because – unlike the services provided by a restaurant or retail store – photography is a form of expression and forcing Elane Photography to provide services on an equal basis would therefore unconstitutionally “compel speech.”

Why ENDA's Religious Exemption Must Be Narrowed

Remarkably, there are only 16 states that currently have workplace non-discrimination laws that are fully inclusive of LGBT people. This leaves LGBT people vulnerable to workplace discrimination in well over half of the country–an unacceptable situation that must be changed.

To address this, last week, the Employment Non-Discrimination Act (ENDA) was reintroduced in Congress. The legislation would prohibit employment discrimination based on sexual orientation and gender identity in most American workplaces, a critically important step towards full equality for LGBT people.
