The hunger strike in Guantánamo is now in its fourth month. At the military’s latest count, 100 of the 166 prisoners are on strike, motivated in large part by their indefinite imprisonment without charge or trial. Twenty-nine of those men are being force-fed, the largest number yet during this hunger strike. Force-feeding in Guantánamo is a brutal, degrading experience.

A detailed and harrowing first-person narrative of a prisoner's experiences in Guantánamo is available to the public for the first time: Slate today published a three-part series of excerpts from The Guantánamo Memoirs of Mohamedou Ould Slahi. The excerpts were culled from a manuscript hundreds of pages in length, which Slahi provided his attorneys, a pro bono team of ACLU and other lawyers. After being classified for years, Slahi's memoirs – of arrest, rendition, torture, and imprisonment without charge or trial – are finally seeing the light of day, albeit with some redactions.

The ongoing crisis in the prison at Guantánamo Bay is escalating, and new details are emerging as media have been allowed to visit this week. A few days ago, as part of an operation to shift hunger-striking prisoners from communal living to individual cells, Guantánamo guards shot at prisoners using what the military calls "less-than-lethal" ammunition, hitting at least one person. The AP reports that five prisoners were injured, as prisoners apparently resisted.

With the world watching, a pre-trial hearing got underway this week in the Guantánamo military commission prosecution of the five alleged 9/11 co-conspirators. Prime among the issues before the military judge was how transparent the commissions will be. The ACLU’s Hina Shamsi argued our motion in support of the public’s constitutional right of access to the proceedings – and against the government’s unconstitutional effort to prevent the public from hearing defendants’ testimony of their torture and abuse in U.S. custody.

I’m in Guantánamo today, expecting to argue the ACLU’s constitutional challenge to the censorship of torture in the military commissions this afternoon or tomorrow.
The Guantánamo military commissions were created in part to hide the government’s illegal torture program while permitting the use of information obtained through torture. Because of improvements in 2009 in the law governing the commissions, it’s harder (though not impossible) for coerced evidence to be used in the proceedings. But the government still wants to hide from the public what it did to prisoners in CIA and military custody.
This past week, I traveled to Guantánamo Bay to observe military commission hearings, continuing the ACLU’s long-standing commitment to be present at each and every hearing of these deeply flawed tribunals.

In Guantánamo Bay last week, I had an enlightening opportunity to talk with Brigadier General Mark Martins—the Chief Prosecutor of the military commissions—along with a handful of other NGO observers of the commissions. There was no agenda for our meeting, but we quickly launched into a vibrant discussion of the wisdom and legality of the military commissions.

At the Naval Base in Guantanamo Bay this week, military commission proceedings have resumed in the capital case against Abd al-Rahim Hussayn Muhammad al-Nashiri, a 47-year-old citizen of Saudi Arabia, who is facing a possible death sentence for his alleged involvement in the bombing of the destroyer USS Cole over a decade ago. Apprehended in 2002, Mr. al-Nashiri was held by the CIA for four years in secret before his transfer to military custody. According to a 2004 CIA Inspector General report, he was waterboarded and threatened during an interrogation with a power drill and handgun.
