ACLU Files Brief Opposing Warrantless GPS Searches

In 2010, the FBI attached a GPS device to the car of a man named Fred Robinson and continuously monitored his whereabouts for nearly two months—all without getting a warrant. Now Robinson is on trial, and on Friday, the ACLU and its affiliate, the ACLU of Eastern Missouri, filed an amicus brief in his case, United States v. Robinson, which raises important Fourth Amendment issues about police use of GPS trackers for surveillance.

Here are some links that have caught our eye recently:

The FBI’s “Next Generation Identification” biometrics database is starting to plan for the inclusion of iris scans. Iris scans raise more issues than some other biometrics (such as fingerprints) because they can be used at a distance without a subject’s participation, permission, or even knowledge. Hand-held iris scanners are being sold to police around the country for identification uses. We were assured in a meeting with the FBI last year that biometric scans in situations such as traffic stops would not be used to enroll individuals into the database, just to check their identity.

Mobile Phone Surveillance by the Numbers

Wow.  Sometimes one word says it all.  The New York Times reports that in response to letters from Rep. Edward Markey (D-MA) and Rep. Joe Barton (R-TX), mobile phone providers disclosed that they received approximately 1.3 million law enforcement requests for customer records last year alone. What an extraordinary number: more than a million accounts subject to at least some level of law enforcement investigation just in 2011. As we have discussed elsewhere, beyond what is reported by carriers in these letters, there is absolutely no reporting or tracking regarding how these numbers are handled.  

Even more amazing, as you dig into the article and read the underlying letters it becomes clear that this is actually a vast undercount of the number of Americans who have been affected by this tracking.  Sprint disclosed that it received approximately 500,000 subpoenas in 2011 (a subpoena is a written request for information from law enforcement that isn’t reviewed by a judge) and that “each subpoena typically requested subscriber information on multiple subscribers.” In addition, several carriers disclosed that they sometimes provide all the information from a particular cell tower or particular area.   Metro PCS for example charges:

$50 for Cell Tower Dump per tower for a 2 hour period
$100 for an Area Dump (if you know the location but do not know the cell towers that affect the area) for a maximum of 2 cell towers for a 2 hour period per cell tower search

Everyone whose phone has been used by a particular cell tower over a particular time period—likely hundreds or thousands of people—could have their data examined by investigators.  And these dragnet data requests are on the rise.  Verizon estimates that over the last 5 years it has seen an average increase of 15% annually, and T-Mobile reported increases of approximately 12%-16%.  This has also led to at least some possible abuse; T-Mobile disclosed that in the last three years it has referred two inappropriate law enforcement requests to the FBI. 

Newest School RFID Scheme is Reminder of Technology’s Surveillance Potential

It’s funny how unpredictable the course of technology is. A few weeks ago it was reported that a Texas school district plans to implant RFID chips in student IDs, and use them to track the whereabouts of students. RFID chips, of course, are what make all kinds of contactless technologies work, from toll booth speed passes to contactless transit passes and entry keys. We have seen attemtps to use RFID’s in schools before and have opposed such efforts, not only because we don’t want to see this kind of intrusive surveillance infrastructure gain inroads into our culture, and because we should not be teaching our children to accept such an intrusive surveillance technology, but also because RFIDs are a generally insecure technology not appropriate for use with children.

More Federal License Scanners Reported

DOJ Ducks Oversight On Location Tracking

How is the Department of Justice using location tracking? If you were looking for an answer to this simple question, this was not the week. Instead, as Congress attempts to oversee this crucial privacy question, it is getting double talk and stonewalling.

Let’s start with the legal standard the Department is using. Earlier this week Senator Al Franken (D-MN) asked Attorney General Holder to clarify the Department’s position on location tracking. Specifically, he asked why, even though experts agree that the recent Supreme Court case US v. Jones stands for the proposition that law enforcement needs a warrant to place a GPS tracking device on a car, DOJ is arguing in another case for a lower, non-probable cause standard. (In an amicus, the ACLU argued that the Fourth Amendment requires that police obtain a warrant to engage in GPS monitoring.) The Attorney General replied that he wasn’t familiar with the case but agreed with Senator Franken that in interpreting Jones they were “likely to be dealing with a situation where we need a warrant.” This frustrating answer seems aimed at reassuring Congress that Americans’ constitutional rights are being protected while DOJ is arguing precisely the opposite in court.

Have State Legislators Staved Off DEA License Scanning On Utah Interstate?

The DEA has withdrawn its request to Utah for permission to install license plate scanners on the Interstate there—but it’s not clear if the agency is abandoning the installation or if it just plans to go ahead without the state’s cooperation (something it has already claimed the power to do).

Extreme Traffic Enforcement

In a recent post I pointed out various ways that license plate recognition devices could be combined with other databases to invade privacy.

One obvious use for ALPR that I did not mention is speeding tickets. If you’ve gotten from point A to point B in less time than would be possible at the speed limit, it would be simple to have the system automatically spit you out a citation. Surveillance drones could also be used for traffic enforcement.

What Your Cell Phone Company Is Telling the Government About You

It’s time for cell phone companies to be up front with customers about how their personal information – including their location history and who they call and text with – is being collected, stored, and shared with the government. DEA Recording Americans’ Movements on Highways, Creating Central Repository of Plate Data

The DEA wants to capture the license plates of all vehicles traveling along Interstate 15 in Utah, and store that data for two years at their facility in Northern Virginia. And, as a DEA official told Utah legislators at a hearing this week (attended by ACLU of Utah staff and covered in local media), these scanners are already in place on “drug trafficking corridors” in California and Texas and are being considered for Arizona as well. The agency is also collecting plate data from unspecified other sources and sharing it with over ten thousand law enforcement agencies around the nation.
