For the past year, the ACLU has been gathering information on local law enforcement agencies’ use of cell phone location tracking. (We’ve written about what we’ve learned here, here, here, here, and here.) In addition to everything we’ve discovered about location tracking itself, we’ve also learned about a number of other techniques law enforcement and the telcos can use when they work together. Sometimes the information came to light because, as with this telecom data retention chart, the information on the other techniques was mingled with the information on cell phone location tracking. Sometimes it was because law enforcement agencies misunderstood our public records requests and sent us everything they had related to telephones.

Last week, the Senate Homeland Security Committee’s Subcommittee on Investigations issued a report criticizing the Department of Homeland Security for its failure to ensure proper oversight over state and local “fusion centers.” Shortly thereafter, the committee issued a statement denouncing the report and lauding fusion centers as playing a “significant role in many recent terrorism cases.”

Late last month a Montreal homicide detective was found guilty of accessing a police database to pass citizens’ information to an organized crime ring to help it ship stolen vehicles overseas. We always keep an eye on these kinds of stories because abuse is one of the risks that is created by governments’ collection of personal data on citizens at all levels. These include records containing sensitive medical and employment history, contact details like email addresses or phone numbers, and even bank and credit card information. But when proponents argue for new databases, the fact that at least some of these records are almost certain to be exposed by crooked insiders is rarely accounted for.

Sen. Al Franken (D- MN) is trying to get some answers to straightforward questions about cell-phone location tracking. Today, using our recent nationwide FOIA as a jumping off point, he sent a letter to the Department of Justice asking them to provide basic information about a practice that, in the words of Justice Sonia Sotomayor, “generates a precise, comprehensive record of a person’s public movements that reflects a wealth of detail about her familial, political, professional, religious, and sexual associations.”

If we do not limit the use of automated license plate readers, it will represent a significant step toward the creation of a surveillance society in the United States.

The conservative Heritage Foundation has issued a report on “Drones in U.S. Airspace: Principles for Governance” with proposals for how domestic drones ought to be regulated. The authors agree with much of what my co-author Catherine Crump and I said in our drones report last year. The Heritage Foundation tends to lean more towards national-security conservatism than libertarian conservatism, so when the ACLU and the Heritage Foundation see more or less eye to eye on an issue like this, it’s a sure sign that a national consensus is emerging.

This past week we saw a strong step forward on photographers’ rights in Washington DC: a groundbreaking General Order issued by the DC police chief as part of the settlement of an ACLU lawsuit. This is the latest in the ACLU’s ongoing effort to fight for the rights of photographers—especially the right to record police—in courts (and courts of public opinion) around the country.

Here are some links that have caught our eye recently:
The FBI’s “Next Generation Identification” biometrics database is starting to plan for the inclusion of iris scans. Iris scans raise more issues than some other biometrics (such as fingerprints) because they can be used at a distance without a subject’s participation, permission, or even knowledge. Hand-held iris scanners are being sold to police around the country for identification uses. We were assured in a meeting with the FBI last year that biometric scans in situations such as traffic stops would not be used to enroll individuals into the database, just to check their identity.

(Update below)
The DEA has withdrawn its request to Utah for permission to install license plate scanners on the Interstate there—but it’s not clear if the agency is abandoning the installation or if it just plans to go ahead without the state’s cooperation (something it has already claimed the power to do).
