Big Data: NSA, Facebook—and My University?

On Sunday, the New York Times published an extensive piece surveying the ways American universities are using their access to students’ information to tailor their college experiences. Universities collect a huge amount of data on their students—course selection and grades, past educational experience and standardized test scores, and other personal information. Austin Peay University analyzes a student’s data and suggests classes in which the student is likely to “succeed.” Arizona State University uses its data to identify students who are “off track” based on course selection and course results. ASU is also experimenting with using information on student swipes of ID cards around campus—at the gym, at the dining hall, at the dorm, at the library, etc.—to understand social ties. (Last week, my colleague Catherine Crump also wrote about universities experimenting with monitoring students’ internet usage to assess mental health.)

Plyler’s Legacy Goes to College

Adriana Sanchez, whose story was recently reported by the Associated Press, was brought from Mexico to Central California at age twelve by her parents, who are both farm workers. The family overstayed their visas. As the AP explained:

Even though Sanchez excelled in high school, she was in the country illegally, lacked a Social Security number and work permit, and didn’t qualify for financial aid. But she volunteered hundreds of hours and paid her way through college and graduate school with a dozen internships. Now 24, Sanchez graduated last week from California State University, Fresno with a master’s degree in International Relations, a full-time job [as an independent contractor] and no loans to repay.

Wearing a Hoodie While Brown Does Not Mean You Are in a Gang

On December 16, 2010, West High School officials in Salt Lake City, Utah invited the Metro Gang Task Force into the school to conduct a gang sweep. Students identified, searched and interrogated by the police were mostly Latino/a or, in the case of Kaleb Winston, African-American.  He was targeted by his school and by the Task Force as a potential gang member, searched and accused of being a tagger. As an artist, Kaleb had a notebook full of drawings in a backpack manufactured to look like it had been spray-painted. But because graffiti is loosely defined, if at all, the police decided Kaleb was a “gang tagger” despite his denials. Kaleb was then forced to hold up a sign with the words “My name is Kaleb Winston and I am a gang tagger.” Law enforcement officers told him that this information was being placed into a database and that the information would be removed if he did not get into trouble for two years. Kaleb was emotionally devastated by the experience. He is not and has never been in a gang. Yet, his attendance at school that day, not bad behavior, made him the subject of intense police scrutiny and he now lives with the fear that the police view him as a suspect.

Standing Up for What You Believe In

In late 2011, the ACLU and ACLU of South Carolina brought a lawsuit against Chesterfield County School District on behalf of student Jordan Anderson and his father, Jonathan Anderson. The lawsuit sought to put a stop to the school district’s widespread religious freedom violations, including official prayer at school events, school-day assemblies featuring preaching, and displays of religious symbols such as crosses and the Ten Commandments. The lawsuit resulted in a consent decree restoring religious freedom to all district students. Religious Rites, Students’ Rights, and Rites of Passage

For several years, the public high schools of Enfield, Connecticut held their graduation ceremony in the First Cathedral Church in nearby Bloomfield. Students, friends, and family entered the building under a large cross, passed through a lobby decorated with religious banners, and entered into the main sanctuary, where the graduation ceremony took place below a stained glass cross and two banners that read “Jesus Christ is Lord” and “I am God.” Attending graduation meant going to church.
