The LA Times Agrees – ENDA’s Religious Exemption Must Be Narrowed

On Thursday, the Los Angeles Times published a powerful editorial arguing that a blank check for religiously affiliated organizations – far beyond houses of worship – to discriminate in employment against LGBT people should not be the price paid to enact the long-sought and critically important Employment Non-Discrimination Act (ENDA).

With Congress having recently approved this year’s NDAA, we think it is important to draw attention to a provision (Section 533(a)(1)), which, though hidden away, is unprecedented, sweeping, and could invite dangerous claims of a right to discriminate against not just lesbian, gay, and bisexual service members, but also women, religious minorities, and in the provision of health care.

Remarkably, there are only 16 states that currently have workplace non-discrimination laws that are fully inclusive of LGBT people. This leaves LGBT people vulnerable to workplace discrimination in well over half of the country–an unacceptable situation that must be changed.

To address this, last week, the Employment Non-Discrimination Act (ENDA) was reintroduced in Congress. The legislation would prohibit employment discrimination based on sexual orientation and gender identity in most American workplaces, a critically important step towards full equality for LGBT people.

Over a decade ago, I had the great honor to be part of a team representing Betty Dukes, an employee at Wal-Mart who had received unfair treatment at her job and had decided to do something about it. Betty soon became the face of a large class of women who worked at Wal-Mart and faced similar types of discrimination in the workplace. These women banded together, from all across the country, to take on sex discrimination at one of the world’s largest employers—and through it all, Betty Dukes remained at the forefront fighting for justice. “In this life,” said Betty, “you have to stand up or be trampled.”  The ACLU co-authored a brief before the Supreme Court, joined by a large number of civil rights groups, highlighting the gender stereotypes that the women were banding together to challenge.

Every day, students in public schools across the country are facing harsh disciplinary measures that may have dire consequences for the rest of their lives.

That was confirmed this week when the Department of Education released Part Two of its 2009-2010 Civil Rights Data Collection (CRDC), which showed minority students face much harsher punishments and penalties in our nation’s public schools than others.

African-American students are 3 1/2 times more likely than their white peers to be suspended. Though African-American students made up only 18 percent of enrolled students, they accounted for 39 percent of those expelled, and were subject to zero tolerance policies at disproportionate rates. A shocking 70 percent of students arrested or referred to law enforcement were Latino or African-American.

Last week, as the nation paid rapt attention, the Supreme Court upheld the Affordable Care Act (ACA) in National Federation of Independent Business v. Sebelius.  The decision is especially critical for women, who are more likely to suffer gaps and discrimination in their health care coverage.  Importantly, it means that the contraceptive coverage rule – which ensures access to affordable birth control for millions of women across the country – is still in place.

On the Anniversary of Griswold, the Facts about Contraception

On this day in 1965, the Supreme Court first protected the right to contraception. A 7-2 decision, Griswold v. Connecticut was joined by justices appointed by Republicans and Democrats alike. It opened the door to a world in which people are free to form intimate relationships, lead healthy sexual lives, pursue educational and employment opportunities, and decide whether and when to become parents. 

And yet now, 47 years later, contraception has become a hot button issue. Much of the recent discussion has consisted of rhetoric such as then-Presidential contender Rick Santorum’s statement that birth control is “not OK, because it’s a license to do things in the sexual realm that is counter to how things are supposed to be”, or the Alliance Defense Fund’s assertion that providing insurance coverage for contraception “propel[s] [us] down an anti-pregnancy path”. On this anniversary, let’s celebrate with the facts:

ENDA Is Good, Could Be Even Better

On Tuesday, the Senate Committee on Health, Education, Labor and Pensions held an important hearing on workplace discrimination experienced by those who are or perceived to be lesbian, gay, bisexual, or transgender (LGBT). The hearing addressed the need for federal legislation, the Employment Non-Discrimination Act (ENDA), to create uniform protections for LGBT people in the workplace.   The sad reality remains that it is legal to fire or refuse to hire workers based on sexual orientation in 29 states and gender identity in 34 states.
