Death Penalty:
The death penalty is the ultimate denial of civil liberties. In the past 35 years, 129 inmates were found to be innocent and released from death row. The ACLU Capital Punishment Project is fighting for the end of the death penalty by supporting moratorium and repeal movements through public education and advocacy. We are engaged in systemic reform of the death penalty process, and case-specific litigation highlighting some of its fundamental flaws.

Indiana Residents: Oppose the execution of Darnell Williams (5/2/2003)

The state of Indiana is planning on executing Darnell Williams despite compelling evidence that he did not shoot the murder victims.  Indiana law only allows the death penalty for the actual killers and the evidence is very strong that Darnell Williams should not be executed.

The evidence that Mr. Williams did not shoot the murder victims (the Reases) is so compelling that the trial prosecutor, at least five jurors who voted for the death penalty, a law enforcement official who investigated the crime scene, and the judge who rejected William's post-conviction challenges to his death sentence, are all urging the governor to stop Mr. Williams' execution.

Take Action!  Urge Governor Kernan to ask that he commute Darnell Williams' death sentence to a life in prison sentence.

Action Alerts: Star Bullet Indiana law only allows the death penalty for actual killers.
Compelling evidence exists that Darnell Williams was not the triggerman, including a witness statement never presented to the jury.  Recently a key prosecution witness, who had testified against Williams at trial, recanted his testimony and is now saying that Darnell Williams was the shooter.

Action Alerts: Star Bullet At least five of the jurors who sentenced Williams to death no longer support his execution.
In light of newly discovered evidence, at least five of the jurors who sentenced Williams to death believe his execution would be an injustice.  Additionally, a law enforcement official who investigated the crime scene, and the judge who rejected William's post-conviction challenges to his death sentence, are both urging the governor to stop Mr. Williams' execution.

Action Alerts: Star Bullet Williams' trial attorneys were incompetent.
Williams' lawyers did not realize that blood had been found on his shorts  - evidence used by the state to prove he pulled the trigger - and so were completely unprepared to defend against it.  Subsequent DNA testing has shown that the blood may not have been from the victims, which weakens the state's case against Williams.  Additionally, his trial lawyers failed to review and present at trial a witness statement that placed Williams outside the victims' home at the time of the murder, making it impossible for him to have been the shooter.
