Official Rules

1) Eligibility: To participate, you must be a US citizen or legal U.S. resident, 17-29 years of age. Contest offered only in the 50 United States and the District of Columbia. Void where prohibited by law. By participating, participants agree to be bound by these Official Rules. The ACLU 2005 Stand Up for Freedom Contest (“Contest”) commences at 12:01 a.m. EST on July 4, 2005, and ends at 11:59 p.m. EST on November 18, 2005. The Contest is run by Zilo Networks, Inc. (“Zilo” or “Agency”) and sponsored by The American Civil Liberties Union (“ACLU” or “Sponsor”). Employees, independent contractors, officers and directors of Sponsor or Agency, their affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, and the immediate family members and persons living in the same household of such persons are not eligible to participate in the Contest.

(2) How to Enter: Submit your entry by sending it via postal mail (postmarked by 11:59pm on November 18, 2005) to The ACLU 2005 Stand Up for Freedom Contest c/o Zilo Networks, Inc., 36 West 44th Street, Suite 1205, New York, NY 10036. Alternately, you may email your entry to info@zilo.com or submit it online via the online submission form on the contest webpage. IMPORTANT NOTE: When submitting your entry, you must also print out and sign the Terms for Submission and send the completed form via postal mail to The ACLU 2005 Stand Up for Freedom Contest c/o Zilo Networks, Inc., 36 West 44 th Street, Suite 1205, New York, NY 10036. Email and/or faxed versions of the Terms of Submission will not be accepted.

Entrants should create their own television Public Service Announcement (“PSA”) and/or written essay for the ACLU to bring current issues to the attention of young people. PSA entries may be any format including, but not limited to, video/film, animation, claymation. PSA's may be submitted via postal mail in the following media formats: ½” VHS, miniDV, or DVD or via email or the online form on the contest webpage in either MPEG or Windows Media Player formats. PSA entries must not exceed 30 seconds in length (and 4 mb when encoded). For essay entries, any type of original work will be considered including fiction, nonfiction, humor, and poetry. Essay entries must be in English.

Entrant must be the sole author and copyright owner of entry or must have permission (via license or otherwise) to use or incorporate portions of their entry authored, owned or controlled by third parties. Neither Agency nor Sponsor are responsible for late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries, none of which will be considered. All entries must include a fully executed, original copy of the Terms for Submission.

(3) Prizes: The winning PSA entrant will receive $5000 and the winning PSA will then be shown on Zilo TV’s national college network and be submitted for airing to major broadcast and cable networks (time and placement of all airings shall be at the sole discretion of Zilo and Sponsor). The winning essay entrant will receive $1000 and the winning essay will be featured on the ACLU’s website and in various communications to its members (all such placements shall be at the sole discretion of Zilo and Sponsor).

(4) Judging: Initial Judging: Once all entries are received, Zilo will narrow the field to 6 PSA semifinalists and 6 essay semifinalists. Final Judging: A panel of judges will review each of the six (6) PSA and essay semifinalists and decide upon the contest winners, one PSA winner and one essay winner, based upon the criteria below. The judges’ decision is final.

PSA judging for both the semifinals and finals will be based on 3 equally weighted criteria: Effectiveness, Production Technique and Originality.

Essay judging for both the semifinals and finals also will be based on 3 equally weighted criteria: Effectiveness, Language and Originality.

Sponsor shall have the right to reject any entry that it considers inappropriate, offensive, defamatory or demeaning to Sponsor's reputation or goodwill. Winners will be notified by e-mail, overnight mail and/or phone on or about December 1, 2005, and thereafter must complete an affidavit or declaration of eligibility/liability release and, except where prohibited, a publicity release and such other documents as may be reasonably required by Sponsor. Failure to return any prize notification or other required documents in a timely fashion may result in forfeiture of the prize and selection of the second place entrant as the winner. Sponsor assumes no responsibility for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify winners. Accepting the prize constitutes permission (except where prohibited by law) to use winner's name, hometown (including state), school affiliation (if any) and/or likeness for promotional purposes without further compensation.

(5) Release from Liability: By participating, entrants agree that Agency and Sponsor, their shareholders, agents and representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and legal advisors are not responsible or liable for, and shall be released and held harmless from: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures or difficulties of any kind; (ii) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (iii) any printing or typographical errors in any materials associated with the Contest; (iv) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Contest, or acceptance of the prize, including without limitation, claims based on publicity rights, defamation or invasion of privacy.

(6) Legal: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New York or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New York.
