Gender Identity & Transgender Rights   

The ACLU advocates for the rights of transgender and gender nonconforming people. We bring discrimination lawsuits on behalf of transgender people, advocate for gender identity inclusion in state, federal, and local anti-discrimination policies, conduct outreach to transgender youth and students on their legal rights, and develop public education campaigns that raise awareness of the types of harms transgender people face.

The ACLU helps to break down society’s narrow idea of what it means to be a “real man” or a “real woman” through public education and impact lawsuits.

Speak Up!
Highlighting the plight of the individual is key to structuring compelling impact cases and moving public opinion. Personal and familiar stories can captivate and persuade people more than legal theories or abstract concepts. The ACLU is searching for personal stories to help us inform elected officials, business leaders, the media, and the public at-large. Please share your story with us.

Gender Identity & the Law
The ACLU is committed to fighting discrimination based on gender identity and expression. We have won important rulings in lower courts by applying protections against sex discrimination to transgender people. Many states have enacted laws that protect gender identity in addition to sexual orientation. Although a few states make it difficult for transgender people to be a parent, most family courts do not have rules outlawing adoption and foster care based on gender identity. But we must do more to overcome blatant abuse and prejudice that judges and lawmakers often accept or dismiss.
