ACLU Reacts to DHS OIG Report on ICE Detainee Deaths and Medical Care (07/01/2008)
Washington, DC – The American Civil Liberties Union (ACLU) reacts to the release of the Department of Homeland Security Inspector General’s report, “ICE Policies Related to Detainee Deaths and the Oversight of Immigration Detention Facilities.” The report examines two of the 33 detainee deaths reported between January 1, 2005 and May 31, 2007 and DHS’s Immigration and Customs Enforcement (ICE) standards related to detainee deaths and the medical treatment of immigration detainees.

Community Group Launches "Know Your Rights" Campaign In Response To Growing Repression (07/01/2008)
Members of Volviendo a Vivir, Respect/Respeto, and Unidos en Arizona have teamed up with Copwatch and the ACLU of Arizona to launch the Valley's largest and most wide-reaching "Know Your Rights" effort to date. Event organizers will kick-off the campaign at 10 am on Wednesday, July 2, at Cesar Chavez Plaza in downtown Phoenix.

ACLU In Federal Court Today To Prevent Deportation Of Egyptian To Torture (06/30/2008)
PHILADELPHIA – The American Civil Liberties Union and ACLU of Pennsylvania were in a federal appeals court today challenging the government's efforts to deport an Egyptian torture victim. The government claims to be relying on unreviewable "diplomatic assurances" from Egypt that it will not torture him upon his return. Last January, in the first decision of its kind, a federal district court sided with the ACLU and ordered the government to stop the deportation of Sameh Khouzam based on such secret and unreliable promises and release him under conditions of supervision. However, the Bush administration appealed this ruling, claiming that the executive branch has unfettered authority to deport Khouzam and to detain him indefinitely pending his legal proceedings.

ICE Immigration Raids Are Reckless and Unconstitutional (05/20/2008)
WASHINGTON, DC – The American Civil Liberties Union commends Chairwoman Lynn Woolsey (D-CA) and the Workforce Protection Subcommittee of the House Education and Labor Committee for holding today’s hearing on immigration raids and their impact on families and communities. Since late 2006 the Department of Homeland Security Immigration Customs Enforcement (ICE) section has undertaken an unprecedented campaign of immigration raids in homes, and worksites. The ACLU has challenged the legality and constitutionality of many of these raids including worksite raids conducted in New Bedford, Massachusetts, and Van Nuys, California.

ACLU Welcomes Detainee Basic Medical Care Act (05/13/2008)
WASHINGTON – The American Civil Liberties Union applauds Senator Robert Menendez (D-NJ) for introducing the Detainee Basic Medical Care Act of 2008. This legislation requires the Department of Homeland Security (DHS) to develop procedures to ensure adequate medical care for all detainees held by U.S. Immigration and Customs Enforcement (ICE). The legislation also requires ICE to report detainee deaths to the DHS and Department of Justice Offices of Inspector General.

Disability Backlogs Violate Due Process Rights (05/08/2008)
WASHINGTON, DC – The American Civil Liberties Union was encouraged by today’s Senate Finance Committee hearing on service delivery problems with the Social Security Administration (SSA) field offices. The SSA has struggled in processing disability claims in reasonable timeframes and the ACLU has concerns that a mandatory employment verification system would capsize the already overburdened agency.

E-Verify Would Cost $40 Billion, CBO Says (04/08/2008)
WASHINGTON – The Congressional Budget Office (CBO) released the estimated cost to implement H.R. 4088, the Secure America through Verification and Enforcement (SAVE) Act of 2007, and found that the proposed legislation would cost taxpayers more than $40 billion over 10 years. H.R. 4088, introduced by Representatives Heath Shuler (D-NC) and Tom Tancredo (R-CO), would implement a national employer verification system and mandate it for all new hires. It is currently under consideration for a “discharge petition” that would allow the bill to bypass the traditional committee markup process and instead go directly to the House floor.

Immigrants' Rights Advocates And ACLU File Lawsuit To End Illegal Delays In Processing Citizenship Applications (04/01/2008)
PHILADELPHIA - Many immigrants who have satisfied the requirements to become U.S. citizens have been illegally left in limbo for years due to the slow processing of FBI "name checks," charged a lawsuit filed today in federal district court in Philadelphia against government officials responsible for the prolonged, system-wide delays. As a result of the lag in "name checks," hundreds or thousands of citizenship applications have been held up well past the 180-day window established by Congress for processing the applications.

ACLU Says Schools Must Provide In-state Tuition to U.S.-Born Virginia Residents Even If Parents Are Undocumented (03/25/2008)
Richmond, VA -- In letters being mailed today, the American Civil Liberties Union of Virginia warns Virginia colleges against denying in-state tuition to U.S.-born students whose parents are undocumented immigrants. The ACLU’s letter responds to a memo from the Virginia Attorney General’s office claiming that undocumented persons are not considered to be domiciled in Virginia and therefore their children are presumed not to be domiciled here as well. One must be domiciled in Virginia to receive in-state tuition.

NYCLU Hails Defeat of Suffolk County Anti-Immigrant Proposal (03/18/2008)
NEW YORK - The New York Civil Liberties Union today hailed the demise of an anti-immigrant proposal by Suffolk County lawmakers that would have required all 15,000 licensed contractors in the county to prove their employees’ working status.

Time Has Come for Real Oversight to End ICE Incompetence, ACLU Says (03/11/2008)
Washington, DC – In light of a hearing examining Department of Homeland Security law enforcement operations, the American Civil Liberties Union called once again for the House Judiciary Subcommittee on Crime, Terrorism and Homeland Security to conduct true oversight over Immigration and Customs Enforcement (ICE), one of the worst violators of civil liberties among federal agencies. Civil Rights Coalition Continues To Fight Arizona Employer Sanctions Law (02/28/2008)
PHOENIX – The American Civil Liberties Union, the ACLU of Arizona, the National Immigration Law Center (NILC), and the Mexican American Legal Defense and Educational Fund (MALDEF) will continue to challenge the so-called Legal Arizona Workers Act in the U.S. Court of Appeals for the Ninth Circuit. The appellate court issued a decision today denying the coalition’s request to delay the law going into effect while the court considers the appeal. The court’s order did not express any view on the statute’s constitutionality and ordered the appeal to be expedited.

Nevada School District Agrees To Allow Students To Speak Spanish On Bus (02/15/2008)
LAS VEGAS – After receiving a letter from the American Civil Liberties Union, the Esmeralda County School District has agreed to make it clear that students are allowed to speak Spanish while they ride the school bus and will send a letter to parents - in both Spanish and English - explaining the district’s language policy. The new policy rescinds a ban on speaking Spanish on the bus that was approved by the Esmeralda County School Board in October 2007.

ACLU Demands ICE End Illegal Deportation of U.S. Citizens (02/13/2008)
Washington, DC – The story of Pedro Guzman, a U.S. citizen born and raised in California, was invoked today throughout a hearing examining Immigration and Customs Enforcement’s illegal deportation of United States citizens. James Brosnahan, of Morrison & Foerster, who is representing Guzman alongside the American Civil Liberties Union of Southern California, testified about the plight of the 30-year-old cognitively impaired American citizen illegally deported to Mexico after he was arrested on misdemeanor charges and sent to Los Angeles County jail.

Federal Court Ends County Official's Policy Of Denying Marriage Licenses Based On Immigration Status (02/12/2008)
SCRANTON, PA – A federal court in Pennsylvania yesterday approved a consent order ending a Luzerne County official's policy of denying marriage licenses based upon applicants’ immigration status. The order, issued in the case of Buck v. Stankovic, makes permanent a previous court ruling holding that the Luzerne County Register of Wills violated the constitutional rights of marriage license applicants by requiring that they show a green card or current visa in order to obtain a license.

LAS VEGAS - El prohibir hablar español a los alumnos de la preparatoria pública, o high school, del Condado de Esmeralda, cuando viajen en el autobús, representa una violación de sus derechos a la libre expresión y discrimina contra los niños de origen latino, acusaron la Unión de Libertades Civiles de los Estados Unidos (American Civil Liberties Union, o ACLU, por sus siglas en inglés) y la ACLU de Nevada, en una carta enviada el día de hoy al Superintendente del Distrito Escolar del Condado de Esmeralda, Robert Aumaugher. La ACLU solicita que el distrito escolar anule de inmediato la prohibición del uso del español.

ACLU Asks Esmeralda County To Stop English-Only Rule On School Bus (01/31/2008)
LAS VEGAS – Forbidding Esmeralda County public high school students from speaking Spanish while riding the school bus violates their free speech rights and discriminates against children of Latino backgrounds, charged the American Civil Liberties Union and the ACLU of Nevada in a letter sent today to Esmeralda County School District Superintendent Robert Aumaugher. The ACLU requests that the school district rescind the ban on Spanish immediately.
