The ACLU will continue to challenge the state's anti-immigrant law, charging that it is unconstitutional in that it unlawfully authorizes police to make warrantless arrests of individuals based on assumed immigration status and criminalizes the mere use or acceptance of the commonly used consular ID card; and unlawfully authorizes unreasonable seizures and arrests in violation of the Fourth Amendment. The lawsuit charges that Indiana's copycat law will lead to racial profiling and trample upon the rights of all Indiana residents.
Major provisions of Indiana's copycat law were blocked last year.
