Specifically, it must be guaranteed that all people tried by a tribunal have access to an attorney of their choosing, confront the evidence against them, are presumed innocent until proven guilty, and are proven guilty beyond a reasonable doubt. All people deserve the right to be treated fairly by the government when the loss of life or liberty is at stake. Evidence must not be obtained through torture or coercive interrogation. Acts of psychological and physical torture violate the very essence of what it is to be a member of the human race. It is unjustified and unacceptable for the United States to engage in acts of torture or coercion. Finally, defendants must have the right to appeal tribunal decisions. All people make mistakes. The individuals conducting the tribunals are no exception. To ensure that tribunal outcomes are non-discriminatory, impartial and just, the people who are tried must be given the right to appeal. Again, I urge you to draft regulation for military tribunals that ensure the fundamental rights of the accused.I look forward to hearing your thoughts on this important matter.
