On May 24, 2006, the ACLU of Massachusetts filed a complaint with the Department of Telecommunications and Energy on behalf of the mayors of Newton, Somerville, Chicopee and Northampton to investigate whether Verizon and AT&T have shared customers' phone records with the NSA. Both Verizon and AT&T have urged the DTE to dismiss the complaint on "state secrets" grounds. The DTE has held no public hearings on the matter in spite of a statutory requirement to do so. The ACLU filed Freedom of Information Act (FOIA) requests for documents relating to the Pentagon's program of spying on peace groups.
