Holding Phone Companies Accountable
The ACLU of Michigan filed a complaint on July 26, 2006, for the Michigan Public Services Commission to investigate whether Verizon and AT&T have shared customers' phone records with the NSA. The phone companies filed a motion to dismiss on "state secrets" grounds, but in September, Judge Mark Eyster ruled in the ACLU's favor, citing that only the federal government, not companies, can invoke the "state secrets" doctrine in its defense.
