DISABILITY RIGHTS

Reviewing whether state prisons that discriminate against prisoners with disabilities can be sued under the Americans with Disabilities Act. DECIDED

The issue in these two consolidated cases is whether state prisons can be sued for discrimination against prisoners with disabilities under Title II of the Americans with Disabilities Act. It is thus the latest chapter in a long-running debate within the Supreme Court about the application of federal civil rights laws to state defendants. The brief submitted by the ACLU and a coalition of other groups documents the long history of discrimination against prisoners with disabilities by state prison systems around the country.
