Because freedom can't protect itself
What uniform did the men who threw tea into Boston harbor wear? Does Indian warpaint count? What uniform did Ethan Allen and The Green Mountain Boys wear? Shall we dig up The Swamp Fox and ship the remains to Great Britain? Judge the current "detainees" by our own historical standards.
The US Prison at Guantanamo Bay, Cuba is an abomination to America, a violation of human rights, a travesty against justice.
Our systemn of justice is adequate for prosecuting any criminal.
Habeas Corpus must be restored to the Constitutional Process it has held since the concept had been adopted by Cheif Justice Marshall. Denial of Habeas Corpus is a denial of Judicial Review. Judicial Review is the process the courts use to determine innocence in jurisdiction over cases at every level of the courts. Justice must be served restore Habeas Corpus now...
I'm no lawyer, but it seems to me that when you continually attack the values we hold dear as Americans, you're attacking America itself. In that sense, those in our government who attack our American way of life are the real "enemy combatants."
It should be obvious to everyone that the "war on terror" is and has been a hoax, created by our government to serve as a platform of justification for all of the "exceptional conditions" rendering strict adherence to the Constitution and U.S. Law unnecessary due to imminent threat to the Nation. A stream of serial lies have emerged from this government from the first, designed to create an aura of fear around the country, and to insure it continues. An entire language of fear has been kept in circulation to convince Americans to feel threatened by dangers that don't even come close to those of traffic deaths. Meanwhile, over 400,000 Iraqi non-combatants are dead who would be alive today if the lies to justify this invasion had not been successful. Some in this government need to pay for these crimes against humanity.
This administration has failed not only the Founding Father's, but it's own citizens! For all who read this and care about the future of this nation....pull up your bootstraps and prepare for battle, we have a long road ahead of us. Thank you to the ACLU for alerting us and defending our freedoms while most of America believed the 'party line' hook, line and sinker.
Now,America we have a problem.....
I just think of the opposite of what this administration is trying hard to make us believe and I'm more apt to get the truth.
UNVERIFYABLE voting machines...
Corruption...secrecy...spying on innocent people...Habeas Corpus...Greedy rich get medical care, education, money to burn,
power, monopolize airwaves-nothing on about slums-hungry-sick...Wars...Health system broken...May take ICC to stop it...
Remember shock and awe in battle strategy? well, the tearing down of our laws that protect personal rights in order to hold sway over the combatants and the civilian population have produced shock and awe in all of us. Anyone who protested was smeared as anti-American,etc. So NOW is the time to get back our basic rights.
We are living a very dangerous time in American politics and if the public does not take active participation in the political system, all of us in the long run will be victims of our own indifference.
We have to "wake up" from the slumber and make sure the system is working for the ideals of this nation. Habeas Corpus needs to be restored. A democracy upholds its values and rule of law above everything else.
Right now we live in a democracy shrouded in propaganda, misconceptions and lack social justice while corporate interests rule at the expense of lives tragically lost and billions misspent.
Enough of the abuse of power.

“Called ‘the most important human right in the Constitution,’ Chief Justice Salmon P. Chase described it in Ex parte Yerger (1868) as ‘the best and only sufficient defense of personal freedom’â€
The Writ of Habeas Corpus is an essential part of court precedent and the heritage of our constitution. Roger Taney’s decisions were so important to the prestige and legitimacy of the high court. He helped mold the early court. Especially in Ex parte Merryman, where the court ruled that only Congress may suspend habeas corpus after Lincoln suspended the privilege of the writ of habeas corpus. The court ruled that Article one of the Constitution grants the right to suspend habeas corpus to congress alone.

Habeas Corpus is also important to the prohibition against false imprisonment. It provides for the transfer of a falsely imprisoned citizen to another site. It is essential to the preservation of our constitutional rights.
