Because freedom can't protect itself
I don't totally understand how the U.S. government can bring these charges against Hamdan, and other prisoners. Maybe I just don't understand law in the US. First of all are we not at war with "terrorists." Doesn't that give the labeled "terrorists" a right and responsibility to fight back. During WWII there had to be direct evidence that a Nazi was giving commands to exterminate Jews. You couldn't just hang Hitlers driver because he heard about what was going on. The charges against Hamdan seem so empty of justice anyways, but doesn't the fact that we are at war give Hamdan a right to fight back. If this is considered a crime why don't we put the students at Columbine who bullied the shooters on trial. They were responsible for shaping the mental state of the shooters, and were more connected with deaths of civilians then Hamdan. Oh that is right they were white and Christian.
