⬅ Return to Sex Offender Law Violates Rights, Puts Kids at Risk

  1. Derek Says:

I am convicted of Att. CSC 4th. I was 19 ans slept with a 13 year old girl that looked more of 18. I didnt know her age and the whole issue came out in court and was openly understood. The girl never came to court and her mother was dating a crack-head and learned she could get money from the "crime rights victim fund."

I met her at a party, didn't know her age and she didn't look young enough to question. Later that night we had sex.
The judge said and I quote, "The Court's willing to accept, for this case, based on the Presentence Report, that it's true that this was not an incident where you forced yourself upon an unwilling victim. I'm satisfied that both of you were probably drunk or at least sleeping it off, and that (victim) was a consenting partner to this sexual act."

It shows a freaky picture of me on the SOAR website (I had just drove back from Florida on vacation and was awake for 29 hours!! Didn't know that was gonna' get plastered all over the internet!) And nevt the charge the says Force and Coersion! There was no such thing! I'm just a regular guy that fell into an unfortunate circumstance that could happen to anyone! I am 34 now married with 3 kids. My family absolutely ROCKS! And my wife is so supportive, along with being Supermom. I have no issue in the city where I live. Everyone in the city knows me and they all love me and my family to death! Everyone knows what happened, and why. But, I am extremely educated and probably one of the best in my field. I have lost every job I have ever valued because of my face and name being on a damn list it has no business being on!!!
I dont know what to do anymore. Now, I am scared to death about kids being mean to kids when my kids get further into school. Now, MY children are under fire!! Especially for a system that does not prevent a thing form some of the people who are real dangers.

If there is some petifil freak on your block, and he wants to get a child, what in the hell is the SOAR list gonna' do?
Freaks like that dont care about reprocussions, they are just driven to feed their desire, and will stop for nothing, not even the SOAR list!! Lets assume your child comes up missing....By the time the ball gets rolling and per say the authorities start going door-to-door checking all the CSC offenders...Do you thing the Petifil is gonna' be home?
Maby if he's real dumb, but chances are he's not! Even then if he is home, and he happens to have the child, what is done is done at that point for all intensive purposes!....So, I dont get it, whats the Registry supposed to do? NOTHING! It makes law makers look pro-active while ruining the life of some people who have NO REASON AT ALL to be on the list for 25 years!! It's like a "Cyber Tar and Feathers", It achieves nothing but humiliation!!

Im not advocating Sexual predators, but for the few of us that are abused by the system and lives turned upsidedown over some innocent teenage BS, especially things like unknown age etc, we need to be let go from this system for sure!

FYI: The girl this all happened with in 1994, out of nowhere approached my mother-in-law, introduced herself and told my mother-in-law who she was and how bad she felt about what her mother had done to my life and that she would do anything she could to fix it. So, I got a lawyer and went back to court with a legal statement about how it all happened signed by the victim, and pretty much the court laughed me out in the street!
    God Bless America

  2. Patty Says:

You can live next door to a terrorist, a murderer, an armed robber, a lifelong thief and never know it. They could murder you, or steal or terrorize your home. Why should sex offenders be hung out in public and astrocized by anyone if they serve there time. They are human beings and when we start treating people worse than animals there is something wrong with our society. Sex offenders have to live in tent cities, cant get jobs, cant ever have a normal life. Even if you have an arrest record and were found not guilty it follows you for life. It is a life sentence. There are wifes and girlfriends that accuse men for offenses to get even, young men who dated young women and did not know the legal age of consent. There are offenders that are not even guilty that were found guilty because the justice system is about how much money you can pay for legal representation. Some states have you register as a sex offender for life if you spanked your child and they decide is is child abuse. What kind of society is this???? Where will it stop??

  3. Frances Says:

I am a mother of an accused sex-offender. We are still in the Federal process but already know what the outcome is going to be like. We have been told by both our federal defender and my sons pre-trial officer that the DA's office goes after cases they can win instead of cases that they might not be able to prove. We have also been told that if they "round-up" all the people that are viewing internet child porn and get rid of the "demand" than the "supply" will automatically stop. My son was not yet 22 when the FBI came to our home to search for proof of a predator. They had been able to "verify" that he had downloaded some child porn from the internet thru "lime-wire" which apparently is a file sharing program. My son was not aware of the seriousness of this law/crime. He had downloaded a large amount of porn in general with some of it being child porn. He has never approached a child or even contacted anyone thru a chat room but now will have to serve a minimum of 5 years in Federal prison and a lifetime of registration. In our same area a 14 year old kills a 6yr child that he was in charge of babysitting and will only have to serve a sentance of 4 yrs in a local prison without a lifetime of being watched once his time is served. The laws in place are not fair or accurate and we are looking at a modern day Salem witch hunt for accused sex-offenders. These laws do need to change. We do not hold a person that owns a gun as a suspected killer somewhere down the road or a person who occasionally drinks a possible drunk driver that will take someones life so why is our government charging people that have no previous criminal record or has never physically harmed another human being has if they will never be an outstanding person of their community.

  4. Helen Says:

If not the ACLU then who will take on this battle? Family and friends of sex offenders and others who believe that the current laws are wrong should be banning together to press congress to change these laws. Recently I received an email from the RSOL website (reformsexoffenderlaws.org)advising that the US Sentencing Commission was looking for public comment on several sentencing procedures and one of these procedures had to due with child pornography. I contacted several websites including Prison Talk and FAMM and had very little response. If politicians don't think anyone is interested they do what they think will get them the most votes, and since this is such a touchy issue no one wants to stand out. I write all politicans, I even wrote Oprah Winfrey after she had John Walsh on her show trying to get support for the Adam Walsh Act, to try and give her the other side of the story. Of course I didn't receive a reply but who knows, someday someone will have the guts to stand up for Americans who are being mistreated. My story is like many of the other. My son is a convicted SO serving the mandatory minimum in a federal prison. The judge was totally against even the 5 years but her hands were tied, and I have met several other young men in the same situation, who I know in my heart, would never do anything like that again, but yet society chooses to keep punsihing them even after they serve their time. My son had been forgiven by God and by his family, he should be able to get on with his life after serving his time.

  5. gene Says:

And sex offenders, by the governments own statistics, have one of the lowest recidivism rates of all offenders. It's only the most hard core that we read about in the headlines.

Just like air crashes...though thousands of planes take off and land everyday- we only hear about the crashes.

What these laws do to families who are trying to recover, and stick together, should be against the law. The one writer is correct...they hurt the people they are trying to protect.

The real nut cases are going to do what they are going to do whether they are registered, on a monitor, on probation, or on the internet. They are powerless over their desires an no amount of monitoring will ever stop that, as recent headlines continue to prove.

  6. anonymous Says:

There are too many people getting caught in the web. I would like to know how many people - or what percentage of the cases - come out only as a divorce strategy.

  7. anonymous Says:

If anyone has not read the paper, No Easy Answers, from Human Rights Watch (linked at the top of this page), please read it. It's heartbreaking and needs to be put in the hands of every lawmaker in America.

  8. Dr.MOJO Says:

I find this law counterproductive especially when some sex offenders are children without any knowledge of state legislation and how a simple decision with thier friends may result in a life with limited to zero education and the chance for true reintegration into society. Children deserve the opportunity for change and growth. Many times this means treatment, self awareness and knowledge.

  9. Dave L. Says:

I went to college for two weeks thinking I could get a Ged Diploma that went out the window today. I was notified that I had to be seen by the Principle and had to explain my crime.
Its a sex offense that happened when I was a Kid 17 years ago Needless to say I won't be getting a Ged. In fear of Vigalantee attack. It has already happened once too me. and I served a Year for defending my self against the Angry Mob. Sex offender Laws have Harmed me all of my Life Maybe suicide is the Final Anwser..

  10. Didty Says:

Why in the world have prisons if when one get out- -be it due to a sex offence or anything else, they are still in hell? Actuaqly worst!
One goes to prison, if possible makes parole- -that cost, it is not free, they PAY for the crime- -and I might say, it is WAY to easy to "cry witch" on a sex offense, WAY to easy. Half of the sex offenders took a plea, no money- -whole thing is no money, then when they do the time, society makes their familes, children relatives everyone KEEP PAYING- -THAT is UNconstitutional- -and by a LOT, not by a mere fraction.
If they do the time, leave them along- -leave them flat alone! OR- -take away ALL PRISONS because it is flat a joke for ANY felon to make it!

  11. Marte Says:

The sad part about enforcement of our current sex offender laws...Adam Walsh Law, Jessica Lunsford Law, Megan's Law, etc. is that whole families suffer. These laws are truly unconstitutional.

  12. George Says:

As a sex offender, I have had first hand experience with the retroactive "ex-post facto" registry laws.
I violated the law in Texas in 1991, and immediately turned my self in. I served my sentence, and then moved to New Mexico to rejoin my family.
I was informed that I had to register despite the fact that I committed my crime four years before the registration law was written.
I have been refused jobs, fired threatened, beaten, and had my property destroyed by disturbed people.
I was incarcerated, and forced to hire a lawyer because I was taking care of my schizophrenic, suicidal 24yar old daughter when I was in town (I was a long haul driver), instead of staying in my residence the four days a month I was in town. Luckily I found another job quickly, so I could pay back the $3500 for the lawyer, and $1000 bond borrowed from my mother, and children.
My ex-wife and I received a visit from the police, and CYFD because some one (her anonymity is protected) accused me of having unsupervised visits with my 17 year old son.
My middle son quit school after a flier telling students to check the offender web site. He has the same name as I do, and was harassed by several students.
I was fired from my last job after my boss was informed I was an offender by a customer.
I was recently informed that I had to notify any future employers, even if I was volunteering.
I took early retirement since I couldn't find a job.
I have been informed that I have to give a DNA sample, which is a violation of my privacy, and recently the law has extended my registration from 20 years to life.
Registration is an inconvenience I can live with, and I can spare the DNA sample, but informing employers(even when there would be no contact with children) and having my picture on the web are additional punishments.
I agree with registration so the police know who the offenders are, and where they live. I find that exposure to the public is setting up offenders for vigilantism, and prevents them from becoming useful citizens.
If you haven't already; read #52 Patty
According to the statistics from before there was registration, less than 5% of offenders re-offend. This is the lowest recidivism rate for any felony.
Most courts now add a treatment plan to their sentence. No other felons get this help, perhaps explaining their high recidivism rates.

  13. Outraged mother/wife Says:

Does anyone truly understand the ramifications of this new SORNA mandate? It is truly outrageous. My son can now no longer have his father go to any school functions (plays, open houses, etc.) without asking for permission from the school board and superintendent of the school along with the principal. Then, after revealing their registration status (which given the nature of my husband's crime-should not have ever been on the registry in the first place) the school can choose not to let him come to any of my son's special activities. My husband can't take my son, or go on any family outings/reunions to any public park with play equipment. Because he is restricted from them, and any public pool, or swimming area. How about now he cannot even go with us to go trick or treating because he cannot be around anyone under the age of 18 on Halloween. He actually cannot even leave the house between the hours of 5-10:30 pm on the night of halloween. We, as a family have to keep all outside lights off, and have to post a sign that no treats will be handed out on our door. Everyone must be thinking, WOW, he must be a real piece of work. Remember, however, that no matter the risk or crime(not a pedaphil or rapist) doesn't matter. They are all equally degraded and their civil rights are being slowly removed. I am outraged and sad, that our government, and some of the people of this country could let this happen. My husband is a wonderful father, who would never dream of hurting a child. A kind, giving, man of God who has been forgiven for his transgressions. He has the support and love of my entire family/friends, and most of all GOD. I guess we really are to the end of times when the bible says, what is wrong will be right, and what is right will be wrong. I wonder if any of these people think about the damage to peoples lives that they cause. We have went from not having to reigster to a prisoner in our own home in the blink of an eye. If we allow this to continue, and leave them unchecked in their treatment of people who have been without reoffense for 17 + years, who knows what they will do next. Please don't think that I think molesters, and pedophiles should be restricted in some manner, and kept track of. I do understand the need for that. My child, myself, my husband, my family are having our Civil rights trampled on.......now where is the justice in that??

  14. Anonymous Says:

My husband is 29 years old and is an unstanding citizen, a wonderful husband and father. When he was 12 years old his aunt accused him of raping his 2 cousins (6 year old girl and an 11 year old boy) keep in mind that he was 12, his mother and aunt were in the middle of an argument at the time. My husband is innocent, both of his cousins and his aunt are very friendly with us and have no problem interacting with my husband (not typical victim/perpetrator behavior). Regardless of the current circumstances, my husband is going to be punished for the rest of his life because at age 12 he confessed to this crime after being badgered by the police and assured that it would be "over" and he could go home. His mother was told that it would not affect him as an adult because juvenile records are sealed. This has not been the case, this happened in 1992, 3 years before sex offender laws were passed in MI. He is now required to register 4 times per year and has to constantly explain himself to others when they happen to find him on the list. He has had no further "offenses" of any kind and his only law violation since was a speeding ticket. It does not seem fair that he can be punished after the orignial sentencing and for the rest of his life for something that happened when he was 12 years old. I hope that the ACLU gives this issue the attention and resources it deserves, yes it is an unpopular issue but if not the ACLU than who? This law is unjust and violates the rights of sex offenders and I feel their families. If anyone knows of anyway to help my husband please let me know, I have searched and searched and there seems to be no help for people on this list.

  15. Paul Winscowsky Says:

Isnt' the title of"sexoffender"suposed to be given to people who commit sex crimes against other people? Then why are the powers that be giveing the title to people that never even touched someone the title of SEX OFFENDER?

  16. Broken & Destroyed Family Says:

My ex-boyfriend is an offender(he was 19 she was 17 and has NOT committed an offense SINCE except for a speeding ticket). This man raised my children for 6yrs before their "real father" decided to came back into their lives. For those 6yrs he treated my babies as his very own, doing all the daddy things, even after our break up in 2006 right up until recently, including being the ONLY FATHER my youngest child has ever known.
Since my children's biological "father" gained the knowledge of my ex's tier 1 status, he's incorporated the aide of DHS(CPS, DYFS and another other name these people/monsters go by) in preventing my children from seeing my ex boyfriend(and the kids call HIM, the ex-boyfriend, daddy). If I have my ex-boyfriend come to MY HOME to visit his step children, I have DHS threating they are coming to remove the children or ARRESTING HIM because THEY want to be satisfied he's not a threat. When did DHS decide who was a threat to our children? Sorry but that's MY JOB as a parent NOT their's.
It's HEART WRENCHING to see my children cry because they can't see him and the ONLY contact they can have is on the phone(he lives 3 hours away from where we do) and to ask "Mom, when can we see daddy again?" I have to always give them the same answer of "Baby, I don't know. Soon I hope". I have to listen to my children come home from their visitation with their "father" telling me how my ex is a pedophile, baby rapist, and all the other disgusting terms he can think of.
My ex-boyfriend and I have been talking about getting back together and the possibility of marriage so we can be a family, but can't for fear of DHS removing "our" children.
"Everyone" screams we must protect our children and yes we must but for God sake's let's use a little common sense!! No re-offending in 17yrs and can't have our family back together?Who's out there to help these families of the ones who are Tier 1s? Don't people understand that there are families out there being torn apart at the seams? Children who cry for their daddies, whether biological or not knowing that they may NEVER have them back in their lives? And let's not forget the wives, girlfriends, signficant others who cry themselves to sleep EVERY NIGHT because that missing piece of their family is torn away knowing that they may NEVER be able to re-sew those seams.
Many of us are screaming HELP US PLEASE but our pleas just seem to fall on deaf ears. We have no where to turn to...DHS? These MONSTERS try to take our children...Law Enforcement? These guys are in cahoots with DHS...Lawyers? In this economy many of us are barely making the monthly bills, forget about trying to find a lawyer(do we pay the mortgage and risk losing our home?)...Legal Aid? HA unless it's a landlord/tenant case they won't even listen to you.
PLEASE SOMEONE, ANYONE help us!! Don't let our pleas fall on deaf ears anymore. Please help us put our families back together.

  17. queenhoneeybee Says:

i am a survivor of sexual abuse, rape, and countless other forms of being violated against. my situation is like many others and in other ways-it is not. i chose to be a survivor and i chose to forgive my offenders and only hope that they can do the same for themselves one day. i TRULY mean it. my concern is protection and rights for sex offenders. i know that there are high-risk offenders and i think that certain preventative measures should be taken to possibly make a chance that they may not re-offend again. in other ways... many offenders that are not high-risk-i feel-that their privacy and personal information is being posted to put them at risk of being harassed/attacked. these people have families too-maybe some that they live with... with children, or wives/husbands, or maybe even living with their mothers. i guess my concern is that once a person is sex-offender (no matter the severity) they are all treated the same in the system-there is no biased. how about a working-class citizen... NEVER been in trouble with the law before or since... and the people they have to report to years after the crime that they paid for-tell them that they don't know why they're 'there'. Not only to have their personal information posted on a site whether it be their home address or workplace... people tend to forget that these people are just that, PEOPLE and are AT RISK to being physically attacked/harassed. There needs to be a better way to appease people and protect the offenders and families of offenders. NOT all are the same. NOT all are high-risk. NOT all are pervs.

i was convicted back in 1992 for rape for which i am not proud of and went to prison, and yet today i aaam still being discrimnated aganist by these lsws. my crime occurred whiled i was in the military, involving another female soldier. i have recently returned back from serving in he war. prior to this offense i had never been in trouble with the law. so within 3 months after my returned and in a drug induce state of mind, it happen and i was convicted through the state judicial system. i put my life on the line on more that one occassion afterall i have already served a 4yr active term and was on my second when the offense occured. i now have 3 children of my own and now i am being told that i cannot be allow on school grounds, parks or etc. inspite of the fact they are still taking my tax dollars to pay for the used of such facilities. how is that fair? they can adding new stipulation to the statues and retroacting them which was in he statues when my crime was committed.

A young man just finished serving time in prison for a sexual contact encounter he had with a younger child when he was 16. The encounter involved touching not sex. This young man is now a new father and is being told that he can not be anywhere near his OWN child. How can this be? Can it be challenged with a lawyer in court? Does he have any rights at all?

I am a sex offender having downloaded approximately 24 images of child pornography back in 2000. I plead guilty in federal court and spent 19 months in a low security federal facility. Upon my release back into Pennsylvania society in 2003, I spent 2 years on federal probation, and complied with all sex offender registration activities, requiring me to maintain registration for 10 years. In 2008, I moved to Illinois. I found out at that time that Illinois considered me a sexual predator, which now requires a lifetime annual registration. Given the fact that there is a 3.3% recidivism among convicted sex offenders, this seems more than harsh. I have paid dearly for my actions and take responsibility for them, but believe this is really going too far. When will this injustice stop?

Me and my uncles have the testimony to help you beat this one. Back in 1999 A District Judge began pirating me for billions of dollars when I was sold to the pharmacuticals, their was never any cross examination for me nor was I ever told about it. It was their direction of questioning of My caseworker when I entered foster care when he visited "should have been" suspect and the should have been suspect fliped the story around to make himself look like the victem. Well Judge Anna. Brown Conspired with OHSU and sold me for Biological Research and Pirated the Military for Office.

Just think about it now Doctor Douglas Heigel works for Both OHSU and Portland Veteran Affair's Medical Hospital. It the military can claim that Bio Tissue's Passed Down through Trait are Connected to Psychological Disorder's, It Saves them Billions upon Billions of Dollars in Veterans Benifits for PTSD for instance, Because then the military could have properly screened troops prior to their entering by looking at their familie's history. When My case worker sold me for this bio research, my family was infiltrated and blackmailed to support their DNA claim being associated with psychological disorder's. The evidence is clear, The Pearl District, Marquam Hill, and the OHSU biotechnowlogy neighborhood development as well as all the newer max lines and the street car, were all founded on that origional picture when my Foster Care Caseworker did that History Background Check and sold me for biological research and "Framed" my Family, That law was passed to keep my uncles from making too much noise because they were framed. It all started with a Picture, and then SORNA came in to float a Frame. (PICTURE FRAME). What I'm wondering now is, if I take Property rights over that Origional Picture, Do I get the Frame as Well?

My daughter didn't even have sex and was dragged into a situation the day after having an all day breakdown, had been off of prozac for maybe a month or so, did all kinds of erratic behavior and went along with her boyfriend the day after melt down which was witnessed by school officials, neighbors, parents, and boyfriend to be let in a window of a 15 and 1/2 girl who had text them to come over and hang out, she didn't know until they got there that were going in that way. I hate to admit I kicked her out the night of breakdown, she had no cell phone and was off her meds and was dependent on the boyfriend, he went back 2 more nights without her and got caught, confessed. They both say my daughter planned it, now she's at DAEP & has missed and will miss several award ceremonies & walking at graduation. She is # 7 in top10% of her class, has missed UIL regionals among the rest. I have evidence off of public FB where this girl says she used my daughter to get to him, and much more on both of them including porn on his laptop which we have, they haven't even bothered to come get. My lawyer who has spent most of my money on communicating with school officials, when I told him that would not do any good, the only thing he could do for me was get charges dropped. The DA has told him twice that he didn't have paper work and would try to get to it because of her academics, she also has $10,000 in scholarship monies to college she may lose. People can't even understand why they charged her. The guy thought he'd get out easier I guess instead it made in aggravated because of act of concert. My daughter has been raped(no charges filed), bullied and an outcast in our town and academics was all she thought she was, am having to watch her closely, for she's been ill awhile, am afraid of what she will do. I don't know what to do. I also feel as if the chief of police has in in for me since I had Austin explain the law to him over a dog bite, he was going to let go because it belonged to a friend. 28. Washington Resident Says:

The local chapters who won't discuss these issues, because they lose financial support and members, may be missing something.

I let my ACLU membership lapse in the late 1990's, when ACLU refused to do anything whatsoever significant in response to the Wenatchee sex abuse witch hunt. I've since watched ACLU dance around these issues delicately, such as in Florida where they raise all sorts of administrative reasons to object to certain laws, but avoid any constitutional argument whatsoever.

These registries have grown to hundreds of thousands of people. Most of us know someone who is on one. It amazes me that ACLU doesn't worry about public opinion on any other civil rights issues but, avoids this one like the plague. If supporting Nazi marchers didn't do you in, then standing up for people made homeless and dis-employed by registration requirements should be easy.

I'll be happy to re-join ACLU, when it can stand up for the victims of these patently unconstitutional laws. It's far from hard to prosecute these crimes. Probably 30% of the defendants are factually innocent. Every one of us is one accusation away from decades in prison. It's turning into a virtual holocaust in this country.

  29. Washington Resident Says:

"We've gotten used to having few friends on this issue. We're okay with this. We didn't get into this business in order to make friends. With the exception of the criminal defense bar, there just aren't a whole lot of people who want to stand up for the rights of sex offenders."

This cuts both ways. I let my membership lapse in the late 1990's, because ACLU refused to get involved in a meaningful way in the Wenatchee sex abuse witch hunt. In fact, most of ACLU avoids the patently unconstitutional application of these laws and the incredibly broad definition of sex crimes in this country.

When ACLU gives this area of the law, that affects hundreds of thousands of Americans, a requisite amount of effort, I'll re-join. Meanwhile, you might be surprised how much support you lose.

The spam filter rejects legitimate comments. The others said it better than me, anyway.

I'll re-join ACLU when they engage on these issues. The individuals here aren't afraid to speak up. Why is ACLU afraid?

  32. Guilty until proven innocent.... Says:

I'm guessing the Laws will change when enough innocent people who's lives are ruined start to "act out" and really do serious crimes. I'm sure there are likely thousands of people.....most likely involved in a divorce that have vindictive spouses that will stop at nothing to destroy their Ex. It's a SICKNESS!!! And THEY should be PROSECUTED. And in many cases, the Prosecutors should be Prosecuted as well, and as their crime does invlove sexual allegations, THEY should be required to Regisster as SEX OFFENDERS, too.

But, back to creating mayhem. I like to quote my favorite comedian, Gallagher; "You have to ATTACK Ignorance & Stupidity with Ignorance & Stupidity. It's the ONLY thing they understand!"

My plan is actually to write a book though. It will obviously read like a BAD Soap Opera, because that's the way it sounds. Maybe I could get it turned into a short mini-series.
