VIDEO: ‘SB 4 Is Patently Unconstitutional and Is Bad Policy’

On September 1 in Texas, SB 4 will take effect. And on that day, all law enforcement across the state will be immediately transformed from police officers into something much different.

“SB 4 says that every local police officer, sheriff, and mayor throughout Texas now needs to enforce immigration law,” according to Lee Gelernt, deputy director of the ACLU’s Immigrants’ Rights Project. And these public servants have every incentive to comply with the law, he notes, because SB 4 “imposes fines in the tens of thousands of dollars, jail time, and even removal from office for violations of law.”

The fear of losing their jobs is palpable among police officers. “I’m worried because my career … it could end,” says Officer Edgar Garcia of the El Cenizo Police Department. “We can be penalized or even … they’ll give us jail time.”

The penalties combined with the very nature of the law, Gelernt explains, will further erode the trust between the police and the communities they serve. This is for two predictable reasons. Police will undoubtedly racially profile Hispanic or Latino people — communities that make up nearly 40 percent of the state’s population. And they will improperly apply the law for fear of being seen as weak on immigration enforcement.

Officer Garcia agrees. “I want to be out here … making people feel safe,” he says. “I don’t want them to feel afraid.”

But under SB 4, they will be.

At a time when there’s a lack of confidence in policing and immigrants are under attack from the highest offices of state and federal government, SB 4 is a terrible law. But it’s also patently unconstitutional, which is why the ACLU, the ACLU of Texas, and cities and counties across the state are currently challenging it in federal court. We expect a decision before September 1, when SB 4 goes into effect.

SB4 is not about hate, nor is it about discrimination although opponents skillfully use their leftest media supporters to try to present it as such. It is a tried and true tactic of the left...if you lie about something often enough some foolish/ignorant people will be swayed. As the 2016 election demonstrqated, however, enough people were smart enough to see through the non-sense from the old guard media to reject HRC. It is disgusting to see parents/people use their children (see photo above related to this blog) to try to promote their lies. SB4 is simply about following the laws of the land, established by "the people." SB4 would not have been necessary if people on the left would not have pushed an agenda to ignore the laws. The left decided they could not win the hearts and minds of people through intelligent and logically supported arguments that would enable change via the legislative branch. So they turned to bullying city officials into ignoring immigration law because it is easier to corrupt a few officials than convince the people to vote for the changes they would like to see. And again, the left skillfully cloaks their agenda in phony altruistic marketing - creating "sanctuary" for illegals, regardless whether they commit heinous crimes (murder - Kate) or not...maintaining the agenda at all cost trumps all all other considerations. For very many Democrats, the ends justify the means. So, violating laws, willfully lying (ACA, "if you like your plan"...) ignoring the constitution, appointing activist judges who ignore their oaths of office, ignoring the will of the people (because of course the elite Democrats know what is best for us Plebs), calling everyone under the sun who disagrees with them a racist, or a bigot or the recently popular Nazi and Fascist. Time will tell how effective these tactics will be, but today much of the polarization in our society is directly attributable to them. I believe that the election of Donald Trump is a direct result of them. Enough people became so angry over these tactics that they actually came out and voted to reject them...in the form of DJT. Democrats/leftists - look in the mirror and you will have your answer as to "what happened."
