Trans Students Deserve Better, President Trump

Late in the day on Friday, President Donald Trump’s Justice Department – now headed by Jeff Sessions – announced that it would drop a challenge to a nationwide injunction against guidance issued last year by the U.S. Departments of Education and Justice on the rights of transgender students under Title IX, a federal civil rights law that prohibits sex discrimination in education. Many now fear that the administration may be preparing to revoke the guidance entirely and change its stance on what those critical federal protections mean for trans students.

This latest action sends a terrible message to some of the most vulnerable young people in the country that the Trump administration does not care about protecting them from discrimination. It was only several weeks ago that the White House proudly announced that “President Trump continues to be respectful and supportive of LGBTQ rights, just as he was throughout the election.” But actions speak far louder than words, and the early signs from Trump’s Justice Department are not good.

It is important for trans students across the country and their parents to know this: The law is on your side, and we at the ACLU will fight to make sure you are protected.

The Trump administration does not have the authority to undo legal protections for trans students. Trans students are protected by the U.S. Constitution and Title IX. School districts across the country must still comply with the law. Schools that have done the right thing by treating trans students with dignity and respect should continue to do so. Schools that discriminate against trans students will continue to face liability in court. Barring trans students from single-sex spaces like restrooms and locker rooms that are consistent with the gender the student lives every day, is a violation of that student’s constitutional and civil rights.

The ACLU is deeply committed to the fight for trans equality, and we will continue our work to safeguard the dignity and rights of trans students.

Next month, the U.S. Supreme Court will hear arguments in Gavin Grimm’s transgender rights case. Gavin is a 17-year-old boy whose Virginia high school has forced him to use separate restroom facilities from all other students because he is transgender. The ACLU sued the school district on Gavin’s behalf, and a lower federal court held that the school board’s actions were unlawful sex discrimination. The school board continued to fight against Gavin’s right to use the restroom all the way to the Supreme Court. 

If the Trump administration will not step up to defend trans students, the ACLU will. Every student deserves the right to a quality education that is free of discrimination. To President Trump and Attorney General Sessions, we say this: Trans students deserve better.

A personal attack that people sometimes make against those who are against gay/lesbian behaviors is to accuse people of being homosexuals. They say this hoping for a reaction-talk of homosexual/lesbian is a good thing, yet call people gay as an insult.

I'm a nonreligious person who sees something wrong with homosexual & lesbian conduct & I think that they must make it a crime to do sex changes. Even if orientation doesn’t change, it’s best for gays/lesbians to be celibate just as it’s best for a person with tobacco orientation not to smoke. If homosexuality is inborn as some scientists believe, then it would be a birth defect.

Never have I heard straights blame childhood sex abuse for reasons a man has sex with a woman and fathers children with her. Yet sometimes have heard gays and lesbians say childhood sex abuse is reason they do same sex behaviors. Sex abuse in youth can cause people to behave in ways. It’s not controversial to talk of nightmares, suicides, bed wetting often a result of sex abuse in youth. Yet when 1 talks gay/lesbian behaviors in adulthood because they learned this sexual behavior by being repeatedly molested, then gays with politically safe psychologists complain. The politically correct psychologists who deny this know it’s possible for a boy to turn out gay as a result of childhood sex abuse, yet deny what they know is true. Of course, not all who are sexually abused in youth become gay in adulthood-but the risk is higher.

Homosexual/lesbian conduct needs to be marginalized such as smoking/tobacco use is. I know my view offends homosexuals, but most smokers do not get offended by negative views of tobacco use. So homosexuals/lesbians have to hear others give negative views of their sex lives, because there is something wrong with this just as there’s something wrong with smoking.

Repair therapy for gays and lesbians who want to be straight must be available just as repair therapy must be available for a drug junky who wants to become clean. For a therapy to have best chance of success, the patient has to want it for themselves. If a person goes into therapy because he or she is pressured by peers into this, they are usu. not going to last long because they don’t sincerely want it. If a kid is a junky and he or she doesn’t want therapy to quit drugs, then it’s usu. going to fail because they don’t want it. You can not force a person into therapy minus a court order and even if you do, if they don’t sincerely want it, it’s usu. will fail. While repair therapy to treat gayism, lesbianism often fails, using what you ask, we also should not have repair therapy to treat smoking, drug junkyism, etc. because that often fails. Minors can not be forced into therapy against will-minus a court order such as requiring medicines for a minor who does not want medicines.

Yes, it should also be the right of homosexuals and lesbians not to go into repair therapy just as I support right of tobacco users not to have repair therapy to quit smoking and I support right of any lucid person to refuse medical care such as if a lucid person’s a heart attack victim and does not want open heart surgery, then it should be their right to refuse this. Yes, proof burden is on repair therapists, but if you aren’t going to have repair therapy for homsexuality/lesbianism, then you may as well not have repair therapy for drug junkyism or drunkardism, because such therapy often fails and high relapses. Is it possible for a homosexual or lesbian to change sexual behavior and sexual orientation to heterosexuality? There are gays and lesbians who sincerely believe they changed to heterosexuality and without contrary proof only they know.

I'm a sexual abuse survivor who studies psychology and I believe it very important to point out some very crucial points you appear to be very ignorant about at best and completely callous toward at worst.

First of all, part of why sexual assault and abuse are so damaging psychologically, especially in childhood, is because they completely invalidate a child's sense of self. The message sent to a child in these acts is this: your feelings, your wishes, your boundaries are unimportant in the face of those of an abuser. Expressing the negative view that any homosexual conduct that might spring forth as a result from sexual trauma as a defect is very disrespectful toward their pain and recovery process. It doesn't repair the damage; it reinforces it. It doesn't sound like that's necessarily your intent but in reality, that is the effect it has on many survivors.

I can't speak for every single survivor but the message I got from this was very invalidating. Reading between the lines of your argument from a survivor's perspective and it becomes "whatever positive feelings you've managed to find after you were raped or molested are invalid and secondary to my belief they are wrong and therefore in need of correction because these are my wishes". Also, it is extremely difficult for many survivors to view sex or any feelings associated with it in a positive or favorable light at all and your response casts more shade on any they do manage to find, reinforcing any pleasure they feel as negative or wrong.

On the behalf of myself and other survivors with similar views and feelings, I implore to you please be more careful and respectful of us when trying to help us recover from our trauma because as I said, your approach to our issues harms more than it helps.


I have thought about this & don't think any1 can rebut conclusion that childhood sex abuse victims of gay/lesbian pedophiles have more risk of turning out gay/lesbian by copying the conduct they learned because think you know that conduct incl. sexual conduct can be learned. Think you know it is possible for people who are victims of same sex molestation (such as victims of gay pedophile priests) to copy this sexual conduct and do gay conduct in adulthood incl. turn out to be gay pedophiles. A kid can become a mugger by living in high crime neighborhood, seeing muggings in childhood and learning this conduct. Yes, there are muggers who were not raised in high crime neighborhoods but still became muggers, but that does not rule out other causes. Many emphysema victims did not smoke and were not exposed to 2nd hand smoke and got emphysema due to bad genes but it would be dishonest to deny truth that if a person smokes, he or she is more likely to get emphysema.

Think posters who call me ignorant, idiot know that sex abuse esp. repeated childhood sex abuse raises risk of a kid turning out gay/lesbian by copying conduct they learned from being ruined by gay and lesbian pedophiles, but they can't rebut other than get offended. You can call me ignorant,idiot, etc., but there's nothing any1 can say to change my mind on this. People who deny truth between sex abuse and later homosexuality/lesbianism are dishonest. I don't think people can rebut conclusion that if a kid is molested esp. a repeated victim of gay/lesbian pedophiles, risk is more they'll copy sexual conduct they learned. I know what politically safe psychologists say denying this possibility, but what they say is not credible & I think they deny what they know is possible. Psychologist or psychiatrist don't know all the answers & can be dishonest by denying what they know is true.
