Kentucky Abortion Ban, Here We Go Again

For the third time in two years, the ACLU has sued Kentucky for blocking access to abortion. We’ve been here before. Once again, the Kentucky General Assembly passed a bill that limits abortion access and, once again, Gov. Matt Bevin signed it into law.

The new law, signed yesterday, makes it a crime for doctors at Kentucky’s last remaining abortion clinic to perform a safe and medically proven abortion procedure known as dilation and evacuation, or “D&E.” Leading medical experts such as the American Congress of Obstetricians and Gynecologists oppose this type of abortion restriction. Earlier this month, an evidence-based and non-partisan report from the National Academies of Science, Engineering, and Medicine described D&E as a “superior method” of abortion after 16 weeks, finding that it is extremely safe with minimal complications.

While the law was being considered in the legislature, two obstetrician-gynecologists testified against the ban, pointing out that a woman’s health, not politics, should drive important medical decisions. But lawmakers disregarded the comments and expertise of these medical professionals and passed the bill anyway.

The advocacy director of the ACLU of Kentucky also testified in opposition to the bill, stating that similar bans in Kansas, Oklahoma, Alabama, Louisiana, Texas, and Arkansas have all been blocked when challenged in court. But lawmakers disregarded her comments, too. Women came to the Capitol to share their abortion stories and faith leaders came to ask legislators to respect peoples’ autonomy to make their own decisions. Lawmakers disregarded all of their comments.

This restriction is part of a national strategy to push abortion out of reach. Since January 2011, state lawmakers around the country have enacted more than 400 new restrictions on abortion that force patients to delay care, shut down clinics, and make abortion care unaffordable. Last year in Kentucky, the ACLU sued and successfully blocked an attempt to force doctors to narrate an ultrasound before an abortion procedure. The state is now appealing that decision. We also sued to keep the doors at Kentucky’s last clinic open when the state attempted to enforce unconstitutional and medically unnecessary restrictions that would have forced the clinic to shut down. We’re waiting for a judge’s ruling in that case.

Kentucky politicians are determined to limit a woman’s ability to get safe and affordable abortion care. But we won’t turn from this fight. We are determined to battle them in court so that Kentuckians can get the care they need and the right to decide what happens to their bodies.

I agree. If they want to prevent abortion, while still having the ability to have sex, stop it at the source. Especially with how difficult it is for women even be able to have their tubes tied (which should be made more accessible in the first place). We can't have all of the blame on women.

I read the comment that the fetus is not a human? What is it then, a frog? Life begins at conception. When abortion is performed that is the taking of a life. My heart goes out to those who find themselves pg and they did not want a baby. I can't imagine. But times have changed adoption is an option or getting help can be had. Give that human life a chance. Too many are using abortion as a birth control.

I'm glad that all of you cowards decided to comment autonomously, it allows me to speak to you all at one time.. YOU all need to look up the definition of a CHRISTIAN BEFOREEE you start throwing cud at others. A) Judge not less the be judged (and YES, I KNOW I am judging you for being ignorant.. and I DO hope I'm judged for being ignorant about things too.) B) Would you RATHER go back to the 50's with women DYING because they were so horribly distraught and scared for the birth of a child they did not want, so they got back alley abortions and coat hangars.. THINK ABOUT IT! Roe v. Wade was a LANDMARK decision not just for womens rights but for the American people as a whole. You need to get an education and learn about this instead of just spouting out of your mouth the rosey colored story that "there's adoption!" JUST do a quick google search: HOW MANY CHILDREN ARE AVAILABLE FOR ADOPTION IN THE UNITED STATES.. HUNDREDS OF THOUSANDS would be the answer you would find. GROW UP! Life is NOT easy for everyone.. LOW INCOME in my area is considered "middle class" and "middle class" is considered RICH>> I do taxes and 90% of my clients DO NOT make over 30,000 a YEAR.. Tell these people that they can afford to have the baby and if they can't, well, someone is just going to come save their baby and adopt it! I mean, geesh at least try it! Someone six states away thinks that you should not have a choice about your own body so carry the baby for them! GROW UPPPPP! I am sick of hearing AMERICANS speak about stuff they are IGNORANT about and picking and choosing HOW to be Christian. I can tell you, GOD understands EACH AND EVERY ONE of the women who have chosen abortion, GOD understands and GOD will make YOU answer for every tear she has shed because of cruel ignorant comments like the ones here. Thanks for showing me that America is really as backwards as I thought it was- most of you probably still think everyone in the world wishes they lived here because ya know, we are just so damn swell.. well guess what? You have no RIGHT to judge a woman who has been in the position to make that kind of decision.. what if it were your 13 year old daughter.. you going to STILL tell her that she has to have the baby? What if your 16 year old is experimenting with sex and her condom breaks? Your 18 year old in college was drunk and date raped? Still not ok to have an abortion? Seriously CAN NOT believe we are even having this conversation in 2018

Oh, and all you idiots saying "abortion is murder"... as (Mirriam-Webster’s Dictionary) “The unlawful killing of another human being with malice aforethought.” In addition, most legal definitions of the word are similar in nature with varying degrees which are subdivided into first and second degree murder. This is where some confusion arises.

It should be noted that under a legal definition of murder, legal abortion would not fit the requirements. In other words, under the law of man instituted by civil government, abortion is not unlawful and would not be defined as murder. However, it should also be noted that the death of an unborn child can be legally counted as murder if there is premeditation, malice involved and done without legal authority (see the Unborn Victims Child Act of 2004- 18 U.S. Code § 1841 - Protection of unborn children).

In the Bible, God both commanded and allowed killing in areas such as war (Genesis 10-12; Deuteronomy 2:33-34), and the death penalty in civil and moral law (Genesis 9:5-6). Killing is a broader term than murder.

22. And should men quarrel and hit a pregnant woman, and she miscarries but there is no fatality, he shall surely be punished, when the woman’s husband makes demands of him, and he shall give [restitution] according to the judges’ [orders]. 23. But if there is a fatality, you shall give a life for a life, 24. an eye for an eye, a tooth for a tooth, a hand for a hand, a foot for a foot. 25. a burn for a burn, a wound for a wound, a bruise for a bruise.
***The woman is not killed in the passage. Only the fetus dies in the encounter. The resulting punishment for the miscarriage is a mere fine. The Bible continues with declaring that had the woman died the death penalty would be imposed under the principle of a “life for a life.” If the fetus was considered a life then the death penalty would be imposed under the principle of a “life for a life” but since a fine is imposed it is understood that the fetus is not considered a life. From this it is clearly understood that a fetus is not considered a full human life, otherwise the punishment would be death under the subsequently enumerated literal biblical principle of lex talionis (‘eye for an eye’).
**** It is also noteworthy that as early as Genesis 2:7, the Bible states that life begins at birth, declaring that God “breathed into his [Adam’s] nostrils the soul of life, and man became a living soul.” The verse implies that until Adam took his first breath he was not considered a living being.

Furthermore, you can scour the Bible with a fine-toothed comb, yet you will not find any passage that describes a prohibition or penalty for a woman who chooses to terminate her pregnancy. Not a single verse yet the anti-abortion movement continues to declare, in the name of God, that abortion is murder. It seems that God left out the prohibition of abortion or perhaps does not consider a fetus a full human life. I’ll let you decide.
