We’re Suing to Block Ohio’s Abortion Ban

Today we filed a lawsuit challenging Ohio’s ban on abortion starting at six weeks of pregnancy. Our lawsuit comes a day after Alabama passed a similar law and weeks after Georgia, Kentucky, and Mississippi passed similar measures.

A ban on abortion starting at six weeks is a ban on almost all abortions. Before six weeks, most people do not even know that they are pregnant. 

Legally, this case is straightforward. A ban on abortion is blatantly unconstitutional under more than 45 years of Supreme Court precedent starting with Roe v. Wade. The Ohio law we’ve challenged today flies in the face of that precedent and of the Constitution. We’ve asked the court to block the law before it can take effect on July 10.

The consequences of this law taking effect would be devastating. Approximately 90% of abortions in Ohio take place at and after six weeks. If this law were to go into effect, the vast majority of Ohioans will no longer be able to obtain an abortion. People of color, people struggling financially, and young people will be disproportionately affected. Black women are three times more likely than white women to die of causes related to pregnancy, and denying women access to desired abortions while failing to adequately address these disparities will only result in more bad outcomes.   

The six-week ban that we are challenging today is not an isolated attack on abortion by Ohio politicians. Instead, it builds on decades of abortion restrictions that already exist in the state, including a mandatory waiting period requiring two trips to the health center, parental consent for minors, and bans on insurance coverage for abortion.

Since 2011, anti-abortion politicians around the country have been chipping away at abortion access, passing more than 400 abortion restrictions. Quietly pushing abortion out of reach in this way has been a core part of the strategy for decades, starting back in the 1970s when U.S. Rep. Henry Hyde (R-Ill.) first proposed a law that prevents people enrolled in Medicaid from using their insurance to cover the cost of an abortion if they need one. In explaining the reason for his proposal, Rep. Hyde said, “I certainly would like to prevent, if I could legally, anybody having an abortion, a rich woman, a middle-class woman, or a poor woman. Unfortunately, the only vehicle available is the Medicaid bill.”

But this year — emboldened by the Trump administration’s attacks on reproductive health care access and the changes on the Supreme Court — states are taking direct aim at Roe v. Wade. Despite strong public support for affordable and barrier-free access to abortion care, they hope the balance of the Supreme Court has turned against abortion rights with enough votes to aggressively and systematically dismantle abortion access. These laws are part of a concerted, national effort to eliminate access to safe and legal abortion. Politicians pass draconian, blatantly unconstitutional abortion restrictions knowing they will get blocked while planning to appeal every legal challenge until they force the Supreme Court to outlaw abortion. 

Along with partner organizations, we have vowed to challenge the Alabama and Georgia measures — just as we have in Ohio — and have already blocked the law in Kentucky. A challenge to Mississippi’s law is pending. Make no mistake, while the right to abortion is under unprecedented attack, abortion is a constitutional right — and it is currently legal in all 50 states. Roe has been the law of the land for over 40 years, and we will do everything we can to ensure that people are able to get the care they need without shame, obstacles, and stigma.

All of these laws making safe abortion access more difficult, expensive, and time-consuming unconstitutionally discriminate against the poor. The wealthy will always be able to access safe abortions. The poor must not be further burdened with unwanted pregnancies. Is part of lawmakers' intent to keep poor people poor?

That is proven in the courts that Trump paid Stormy Daniels $130K to prevent her from revealing their tryst, showing that the wealthy can hide things with their money; or that the abortion for Karen McDougal was paid for with another $130K from Trump to keep her from revealing their tryst and her pregnancy as a consequence. So you've got it right, the Republicans will just hide the practice they use which they deny it to others without regard for the law.

The quickest way to prevent anti-abortion laws: It's blatant sex discrimination to punish only the woman. Identify the father and slap him with 100% financial responsibility for the child should it be born.

Abortion is not a religious issue. It is the personal choice of the individual making the decision and hers alone.
This issue is to obtain control of women as men had in the past. I am an RN I understand the importance of autonomy and civil rights.
There are untold scenarios which may necessitate an abortion this is simple. If a woman is forced to give birth to an unwanted infant that would be a travesty. She may have to quit her job then go on welfare then have the republicans and public condemn her for having a child. I got pregnant while taking birth control pills. Childcare is very expensive. She may be shamed and harassed into keeping the infant, by family and friends. The infant may never feel loved. It may be abused. But that is an acceptable risk to christians and republicans. Of course the wealthy will have access to safe abortions even if illegal. The rules do not apply to them.
Christians and others make excuses for woman saying there are so many people wanting to adopt. Why are not christians adopting the 107.918 children in foster care right now. No, it has to be a pure baby. Not contaminated by a few months or years of life. Their motto: Do as I say not as I do.
Pro-choice individuals may believe as they please.

Pro-choice christians should follow the teachings of Jesus.

According to the New Testament if someone is aced they still sin all they have to do is repent it makes them a new person. So the sins below as spoken by Jesus must not apply to christians even though they are still human. I have heard and read of evangelicals professing the sins listed below all they are required to do is repent, of course they have had to repent many times. I call this hypocrisy. A female having an abortion may be saved all she has to do is repent.

Abortion should be safe legal and rare but nutters have been restricting funding and access to birth control and family planning information, as well.
No worries, monied ladies...you of the landed gentry - I'm sure privilege will see you through this period of devolution. As always, families of the poor and working poor will suffer most.
Saddest of all, the more mouths to feed, the less likely a woman would be able to afford to leave a crappy job, a limited future for herself and her children, an abusive spouse or dangerous situation.
Nothing more hateful or destructive than hysterical missionaries, incapable of rational thought, impervious to factual information, and bent on imposing the particular brand of dogma, that they themselves are manipulated and imprisoned by.

Dear supra-religious people,
Dominance and submission, sadomasochism, fear and shame; these seem to be your favorite turn ons. (At least, it seems the dogma you prefer, is drenched in these overtones). If that's the lifestyle you prefer, it's ok by me, as long as you don't impose these particular penchants on your unwitting children.
And please, try to remember, your grim desires aren't necessarily everyone's cup of tea.

I know too many women who exist quite happily, women who love and are loved as autonomous beings, without having to entertain a succession of paternalistic overseers to "sheild" them from gaining independence...or enjoying the occasional apple.
