'No-Fault' Attendance Policies Penalize Pregnant Workers and Anyone Who Gets Sick

As any woman who’s ever been pregnant will tell you, those nine months can be a physical roller coaster, with symptoms ranging from nausea to intense fatigue to joint pain to urinary infections.  And that’s just a “normal” pregnancy. Countless women also suffer from complications like hypertension, diabetes, and placenta previa. At the very least, pregnant women need to see their doctors once a month for prenatal care, increasing in frequency to bi-weekly and then weekly in the final stages of pregnancy.  

Consequently, whether it’s because of morning sickness, a delay at the doctor’s office, or pain so severe that she needs to go home before quitting time, pregnancy is virtually assured of interfering with even the most diligent employee’s ability to work her usual hours. That this major medical event might disrupt a woman’s schedule should come as no surprise. But what is surprising is how unforgiving our workplaces are to pregnant workers — and to any worker who fails to be in perfect health every hour of every day. 

Our country’s shameful lack of paid family leave and sick days has been well-publicized. Less well-known is the prevalence of “no-fault” attendance policies, which do not distinguish among the reasons an employee might be late or absent. No-fault policies punish tardiness and absence with demerit “points” and, at a certain threshold, result in termination. 

That’s exactly what happened to our clients Katia Hills and Cynthia Allen, whose pregnancies cost them their sales jobs with AT&T Mobility. Today, the ACLU Women’s Rights Project joined the law firms of Cohen Milstein Sellers & Toll and Indianapolis-based Cohen and Malad to file a nationwide class-action lawsuit charging that AT&T Mobility’s no-fault attendance policies for retail employees violate the Pregnancy Discrimination Act. The suit also brings individual claims on Hills’s and Allen’s behalf under the Family and Medical Leave Act and the Americans with Disabilities Act.  

No-fault policies, also known euphemistically as “maximum leave” or “absence control” policies, have been growing in popularity among employers for decades. But their potential for violating employees’ civil rights has been recognized from the start.  Indeed, the Department of Labor cautioned in 1993 against companies using a no-fault policy to penalize employees for FMLA-qualifying absences — such as to attend to one’s own serious medical condition or to care for a seriously ill family member. The Labor Department still continues to warn employers against assessing points for FMLA-qualifying leave — including “intermittent leave,” which can be as short as a day or even an hour. 

The U.S. Equal Employment Opportunity Commission considers it a violation of the ADA to assign points for tardiness or absence attributable to an employee’s disability, unless permitting the leave would pose an undue hardship to the employer. Employers that ignore this directive can face stiff consequences. In 2011, Verizon paid $20 million to settle the EEOC’s ADA lawsuit challenging the company’s no-fault attendance plan. It’s the largest ADA settlement to date. 

Although precise statistics about no-fault policies’ prevalence are hard to come by, a 2010 survey of over 1,000 human resources professionals found that 40 percent of their employers relied on some form of “absence control.” Meanwhile, a 2006 study of union arbitration proceedings found that terminations or other disciplinary actions for absences caused by personal or family needs featured prominently among the disputes. 

No-fault policies are especially common in low-wage fields, like health care and retail, and in higher-wage, unionized fields, such as construction, janitorial services, and transportation. After all, these are jobs that prize workers’ output over all else — sales numbers, production quotas, customers served. Walmart, the nation’s largest private employer, is currently the target of discrimination charges stemming from its point-based attendance policy, whose many harms to pregnant, sick, and disabled workers and family caregivers were documented in a report by the worker activists and advocacy group, A Better Balance. 

Our lawsuit against AT&T Mobility appears to be the first of its kind: a class-action lawsuit challenging a company-wide no-fault policy on behalf of pregnant workers. For the many employees harmed by the policy at the company, and the thousands more at employers around the country for whom pregnancy and family obligations have earned them a pink slip, we are sending a message: Workers are human beings, not machines.

They should bring back good, old fashioned, slavery. It would eliminate a lot of confusion as to who's who and what's what. Bring back Feudalism too, might makes right.


This article would be more inclusive and accurate if when discussing pregnant people you used gender neutral terms. People of all genders including trans men and no binary people can become pregnant and face discrimination for it, not just women.




I work for AT&T and was almost fired for being in a car accident and missing work. One of my coworkers was almost fired for missing work to go to cancer screenings. If we didnt get FMLA approval we would have been fired.

What you conveniently (purposefully?) do not address is the impact on any business when workers are absent. The businesses that pay the wages and the benefits of the workers. What is "wrong" about the employer who pays the wages & benefits establishing and publicizing its expectations of employees to be at work? What is "wrong" about the employer who pays the wages & benefits from taking corrective action(s) towards employees who have absences (for whatever reason(s)) that exceed the expectations? As long at the "no-fault" attendance policy is applied in a non-discriminatory manner, it is not "wrong" or unlawful. It seems the class action lawsuit is trying to establish a "disparate impact" claim because "no fault" attendance policies, even though enforced consistently, may have a disparate impact on pregnant employees. When you have the experience of owning a company, regularly making payroll, and dealing with employees, your perspective will change. You should read the article "NIBBLED TO DEATH" written by former U.S. Senator George McGovern regarding his experience trying to run a business after he left the Senate. His liberal, employees are always screwed by their employers mentality changed drastically.


I had a boss who seemed to just want everyone to work crazy hours; ‘do more with less’ ‘it is what it is’; while our comissions went down, but we managed to be more profitable. But what about the long term cost? Disengaged employees, percieved “bonding” by common enemy intimacy, turn over, increased employee stress/illness/injury, Little or no trust in company leadership both direct and indirect, mostly all employees near termination (or groups of employees,) most of us seem to have been wronged but with no accountability from management or union we are shouting blame at each other over things we wouldnt want to happen because maybe we “believe” the only way to be valued or make a contribution is if we are “taking one for the team” I.e me saying “I think this is unfair “ but With (so and so) on pregnancy leave or mental disability leave, we are short staffed, and I it’s not really that big of a deal anyway.” not encouraged to seek advancement in higher company roles, not given tools to rise within the company, working loads of overtime, discouraging protective leave, creating a hostile work environment, favoring a group of employees, excludIng groups of employees etc. according to https://www.workplacestrategiesformentalhealth.com/psychological-health-and-safety/Discrimination-and-Diversity “The costs associated with discrimination in the workplace (real or perceived), ranging from negative attitudes among employees towards the organization, disruption in employee cohesion, reduced job performance, loss in job productivity, and lowered job satisfaction, reveals that organizations that provide positive reinforcement of diversity are more likely to experience positive outcomes.”

So as much as people perceive this idea that pregnant woman, disabled employees(yes, that includes mental health in you’re wondering,) and other marginalized groups are complaining too much, costing more to companies, too entitled, hurting coworkers, etc. as a sound logic opinion that doesn’t have time for ‘under marginalized’ data supporting inclusion and diversity because it’s inconclusive: the numbers still lean on inclusion and diversity to boost even the bottom line. There’s is more than two options, this is not political rhetoric, this is about basic dignity, respect, human rights, civil and equality. We are forgetting that we are all human.. and ignoring or justifying bad behavior never helps the ones getting beaten down.


I work for Walmart and they just updated the points policy. It is now more strict, while they claim more generous. Ha! They will assess double and quadruple points on certain days if one does not have a new category of PTO to cover the absence, which accrues slows, and the entire PTO was overhauled because they stopped paying us for holidays. On top of that, we must make time off requests one month in advance.
