Whether the anti-retaliation provisions of Title VII protect an employee who alleges that he was dismissed because his fiancée filed a sex discrimination claim against the employer with the EEOC.
Title VII of the 1964 Civil Rights Act prohibits employment discrimination on the basis of race, sex, and religion. It also prohibits retaliation against employees who report discrimination. The question in this case is whether an employee who claims he was terminated because he was the fiancée; of an employee who filed a sex discrimination charge with the EEOC can sue under the anti-retaliation provisions of Title VII. Joining with more than two dozen other civil rights groups, the ACLU argues that the answer to that question is yes.
