On January 16, 2024, the ACLU and the ACLU of Arizona filed a friend-of-the-court brief in support of Ahmed Alahmedalabdaloklah’s petition for rehearing of his criminal appeal before the Ninth Circuit Court of Appeals. Throughout the government's investigation and prosecution of Mr. Alahmedalabdaloklah, prosecutors obtained evidence and witnesses from CENTCOM, a component of the Department of Defense. Despite that cooperation, prosecutors refused to ask CENTCOM to search for exculpatory evidence essential to Mr. Alahmedalabdaloklah’s defense. Our amicus brief argues that the government’s failure to search CENTCOM for exculpatory material violated bedrock due process principles under Brady v. Maryland, 373 U.S. 83 (1963).
