On May 30, 2023, the ACLU submitted a comment to the Federal Trade Commission (FTC) and the Consumer Finance Protection Bureau (CFPB) in response to a request for information seeking public comment on tenant screening issues, including how the use of criminal and eviction records and algorithms impact tenant screening decisions and often result in discriminatory outcomes for people of color, and in particular, Black women and their families. In its comment, the ACLU urged the FTC and the CFPB to collaborate with each other and other agencies, including the U.S. Department of Housing and Urban Development (HUD), to conduct investigations into the tenant screening industry; issue regulations and/or guidance concerning the obligations of tenant screening companies and tenant screening practices that may be unlawful under the Federal Trade Commission Act (FTCA); and issue guidance for tenant screening companies on complying with the Federal Credit Reporting Act (FCRA), including their disclosure obligations.
