In this letter to the House Judiciary Committee, the ACLU urged Members of Congress to oppose H.R. 2896, the Stopping Harmful Image Exploitation and Limiting Distribution Act of 2019 (SHIELD Act). While we agree that the government has an important role to play in preventing the nonconsensual distribution of intimate images, the SHIELD Act’s unconstitutionally broad sweep confers too much discretion on law enforcement officials and threatens to chill expression on matters of public concern.
