This May 25, 2016 vote recommendation sent to the Senate Judiciary Committee urges Senators to pass ECPA reform legislation without weakening amendments. The ACLU strongly supports the Senate’s version of ECPA reform, S. 356, the Electronic Communications Privacy Act Amendments Act as well as the similar House-passed legislation, H.R. 699, the Email Privacy Act, which unanimously passed the House in April. This letter urges against amendments that would derail the strong bi-partisan support of ECPA reform, including amendments that would expand the National Security Letter statute, create mandatory emergency exceptions, or create overbroad exceptions to the warrant requirement in cases where the user may not have appropriately provided consent.
