In this letter, the ACLU urged Senators to Vote No on the Online Content Policy Modernization Act, S. 4632 when the bill is put forth at the Senate Judiciary Committee’s markup on October 1, 2020. The bill amends Section 230 of the Communications Decency Act in ways that would interfere with online platforms’ ability to fact-check or restrict access to content on their sites, including content such as voter suppression. In the midst of a global public health crisis that has shifted even more public discourse online and the upcoming U.S. general election, tying the hands of platforms seeking to mitigate potential harms, and enable, organize, and respond to online speech is the last thing Congress should be doing.
