Coalition Comment Letter Opposing DHS Social Media Retention Policy

Document Date: October 18, 2017

On October 18, 2017, the ACLU joined a letter with coalition partners in response to a notice and request for comment from the U.S. Department of Homeland Security (DHS) regarding social media retention. The ACLU and its coalition partners urged DHS not to retain social media information in “Alien Files” files, which can include the official record of an individual’s visa and immigration history. The comment highlighted concerns that the collection, retention, use, and sharing of social media information will: (1) invade the privacy of immigrants and U.S. citizens alike; (2) chill freedom of speech and association; (3) invite abuse in exchange for little security benefit; and (4) establish a system that treats naturalized citizens as second-class citizens.
