Coalition Letter on the Department of Defense's FOIA Proposal for the FY2021 NDAA

Document Date: April 20, 2020

The ACLU joined this coalition letter urging the House and Senate Armed Services committees to reject a Department of Defense proposal to alter the Freedom of Information Act (FOIA) via the FY 2021 National Defense Authorization Act (NDAA). The federal government may already withhold properly classified information under FOIA and unclassified information under a variety of other statutes. Contrary to FOIA's goal of transparency and accountability, the Pentagon's legislative proposal is an overbroad and unnecessary secrecy provision that could be easily abused to keep the public in the dark about matters of compelling public interest involving our military.
