The ACLU and coalition partners wrote to the House and Senate Armed Services committees to urge them not to include a Department of Defense (DoD) proposal to alter that Freedom of Information Act (FOIA) in the FY 2018 National Defense Authorization Act (NDAA). The proposal would create an exemption to FOIA for much of the information and documents created by DoD, and would undermine FOIA’s goal of transparency. While the proposal is narrower than two previous iterations, it remains an unnecessary and overbroad secrecy provision.
