Coalition Letter in Support of Dept. of Education and Dept. of Justice Guidance on School, District, and State Responsibility to Protect Transgender and Gender Non-Conforming Students from Discrimination

Document Date: May 20, 2016

This coalition letter, signed by the ACLU, strongly supports the joint guidance issued by the Departments of Education and Justice on May 13, 2016, regarding the responsibility of schools, districts and states to protect transgender and gender non-conforming students from discrimination. The guidance reiterates that discrimination against transgender students is a violation of Title IX of the Education Amendments of 1972. It also provides schools, districts, and states with clarity about their responsibility to protect transgender students from discrimination, for example, by making clear that schools must provide access to restrooms and locker rooms for transgender students consistent with their gender identity.
