ESI Amicus Brief

The ACLU filed an amicus brief before the Board of Immigration Appeals arguing that immigrants with mental disabilities who cannot represent themselves are entitled to appointed counsel so that they can receive fair notice of removal proceedings.

The brief was filed in conjunction with the organizations litigating Franco-Gonzales v. Holder, a class action on behalf of detained noncitizens with mental disabilities in California, Arizona, and Washington, and with the American Immigration Lawyers Association, the American Immigration Council, and Texas Appleseed.
