This letter was submitted for the record to the House Judiciary Subcommittee on Courts, Intellectual Property, and the Internet for their Nov. 3, 2015 hearing on “International Data Flows: Promoting Digital Trade in the 21st Century.” The letter notes the impact that U.S. surveillance practices had on a Court of Justice of the European Union judgement ruling invalid the E.U.-U.S. Safe Harbor Agreement. The letter urges Congress to, at a minimum, reform Section 702 of the Foreign Intelligence Surveillance Act so that subsequent Safe Harbor Agreements will be able to withstand judicial scrutiny.
