ACLU Letter on House Judiciary Subcommittee on Courts, Intellectual Property and the Internet hearing on ‘International Data Flows: Promoting Digital Trade in the 21st Century'

This letter was submitted for the record to the House Judiciary Subcommittee on Courts, Intellectual Property, and the Internet for their Nov. 3, 2015 hearing on “International Data Flows: Promoting Digital Trade in the 21st Century.” The letter notes the impact that U.S. surveillance practices had on a Court of Justice of the European Union judgement ruling invalid the E.U.-U.S. Safe Harbor Agreement. The letter urges Congress to, at a minimum, reform Section 702 of the Foreign Intelligence Surveillance Act so that subsequent Safe Harbor Agreements will be able to withstand judicial scrutiny.
