This April 12, 2016 letter from the ACLU urges the House Judiciary Committee to support H.R. 699, the Email Privacy Act, and to pass the original version of the bill. It also urges additional amendments to strengthen the bill, including a suppression remedy and requiring a probable cause warrant for location information. However, the letter also expresses disappointment at the manager’s amendment to H.R. 699, which eliminates critical privacy protections, such as a requirement that the government notify individuals when they seek to access the content of their electronic information.
