Whether employees who cooperate with an internal investigation of alleged sexual harassment are protected against retaliation under Title VII of the 1964 Civil Rights Act.

Title VII of the 1964 Civil Rights Act prohibits employment discrimination, including harassment, on the basis of race or sex. It also protects employees from retaliation for opposing any unlawful discrimination or participating in an investigation of unlawful discrimination "under" Title VII. The question presented is whether this anti-retaliation provision protects employees who participate in an internal company investigation of alleged sexual harassment. Joining with numerous other civil rights groups, the ACLU filed an amicus brief arguing that a failure to provide employees with protection in this circumstance will make it even harder to correct what is already a pervasive and under-reported problem of sexual harassment in the workplace.
