About 4600 children live in state custody in South Carolina, waiting for a placement with a family that may never come. Despite this, Governor Henry McMaster applied for and received a waiver permitting discrimination in foster care based on religious beliefs, authorizing a major foster care agency (Miracle Hill) to screen out prospective foster families that do not adhere to their evangelical Protestant Christian beliefs and families headed by same-sex couples regardless of their faith. This morning, we filed suit against Trump's HHS & South Carolina for enabling this discrimination in the child welfare system. Our clients, Eden & Brandy, applied to foster with Miracle Hill, and were denied because they failed Miracle Hill’s religious litmus test. We're joined in this lawsuit by the ACLU of South Carolina, Lambda Legal, SC Equality Coalition, and Cravath, Swaine & Moore LLP.
