Americans Overwhelmingly Support a Fair Immigration System

By Laura W. Murphy, Director, ACLU Washington Legislative Office at 10:19am

For over 90 years the ACLU has defended the rights of everyone in the United States, whether born in this country or abroad, because the Constitution protects the civil liberties and civil rights of all of them.

The data from a new poll released yesterday that was commissioned by CAMBIO, a new coalition for immigration reform, confirms what we have long known – that the American people agree wholeheartedly that all people in the United States, including immigrants, have fundamental rights under our Constitution.

African Americans Are Key to the Success of the LGBT Movement

As 2012 draws to a close and I reflect on the historic year that was, one of the things that I am most proud of is the role that African Americans played in helping to bring the freedom to marry for committed and loving same-sex couples to my home state of Maryland.

Time for Obama and Holder to Truly End Racial Profiling by Law Enforcement

By Laura W. Murphy, Director, ACLU Washington Legislative Office at 12:18pm

Why can’t President Obama and Attorney General Eric Holder do more to ban racial profiling in the United States?  Surely, more so than any of their predecessors, they can understand the injustice and humiliation racial profiling victims feel when they are treated as suspect because of the color of their skin.

Yet, after four years in office, they’ve made no revisions to the Justice Department guidance regarding the use of race in federal law enforcement issued by Attorney General John Ashcroft in 2003.  Ashcroft’s guidance was deficient: though it expressly banned racial profiling by federal law enforcement agencies, it left broad exemptions for national security and border integrity investigations.

Technology has changed dramatically since 1986. With free, unlimited email storage and high-speed broadband service widely available, we no longer have to download email onto our hard drives. Instead, we indefinitely store our email and other personal effects — private reflections, financial records, photographs and love letters — in the "cloud," where the power and flexibility of massive servers are available for free or at very low cost.

Are the FBI and Congress Politicizing Terrorism Intelligence?

By Laura W. Murphy, Director, ACLU Washington Legislative Office & Mike German, ACLU, Washington Legislative Office at 11:18am

Since 1990, 670 people have been killed and 3,053 injured in attacks by far-right extremists in the United States, according to a new study by the Combating Terrorism Center (CTC) at West Point.  Perhaps more frightening, the CTC says its data shows the number of violent attacks has increased precipitously since the late 1990s, and especially since 2006.  The report has generated a predictable (and frankly deserved) backlash against it, highlighting the difficulty government agencies have had in analyzing politically-motivated violence in an objective manner.

“Fixing” Citizens United Will Break the Constitution

In “Fixing Citizens United,” Professor Geoffrey Stone—usually a friend to the First Amendment—argues for a constitutional amendment to “fix” the Citizens United Supreme Court decision. Professor Stone mentions the proposal rather offhandedly, but the idea is a nuclear option. A constitutional amendment—specifically an amendment limiting the right to political speech—would fundamentally “break” the Constitution and endanger civil rights and civil liberties for generations.

The Three Faces of Racial Profiling: The ACLU Connects the Dots

By Laura W. Murphy, Director, ACLU Washington Legislative Office at 11:32am

Racial profiling not only goes against our Constitution and our country’s value for equality — it also hinders law enforcement officials from doing an effective job.

The Right to Vote: Let's Not Forget Where We've Been and How Far We Need to Go

By Laura W. Murphy, Director, ACLU Washington Legislative Office at 3:36pm

Despite the progress our country has made since the passage of the Voting Rights Act, voter suppression tactics remain a serious threat to the right to vote.
