In “Fixing Citizens United,” Professor Geoffrey Stone—usually a friend to the First Amendment—argues for a constitutional amendment to “fix” the Citizens United Supreme Court decision. Professor Stone mentions the proposal rather offhandedly, but the idea is a nuclear option. A constitutional amendment—specifically an amendment limiting the right to political speech—would fundamentally “break” the Constitution and endanger civil rights and civil liberties for generations.

Since 1990, 670 people have been killed and 3,053 injured in attacks by far-right extremists in the United States, according to a new study by the Combating Terrorism Center (CTC) at West Point. Perhaps more frightening, the CTC says its data shows the number of violent attacks has increased precipitously since the late 1990s, and especially since 2006. The report has generated a predictable (and frankly deserved) backlash against it, highlighting the difficulty government agencies have had in analyzing politically-motivated violence in an objective manner.

Why can’t President Obama and Attorney General Eric Holder do more to ban racial profiling in the United States? Surely, more so than any of their predecessors, they can understand the injustice and humiliation racial profiling victims feel when they are treated as suspect because of the color of their skin.
Yet, after four years in office, they’ve made no revisions to the Justice Department guidance regarding the use of race in federal law enforcement issued by Attorney General John Ashcroft in 2003. Ashcroft’s guidance was deficient: though it expressly banned racial profiling by federal law enforcement agencies, it left broad exemptions for national security and border integrity investigations.
