The ACLU joined a coalition letter reiterating opposition to S. 1622 Stopping Overdoses of Fentanyl Analogues Act (SOFA) and thus opposing other legislative efforst, such as through the appropriations process, to extend the “class-wide” emergency scheduling ban that SOFA seeks to make permanent. SOFA would grant the DEA broad authority in the scheduling process of fentanyl analogues, increase sentences, and expose many more individuals to harsh penalties, including mandatory minimum sentences.
