Cody Wofsy is deputy director of the ACLU Immigrants’ Rights Project. His work focuses on limiting state and local entanglement with immigration enforcement, ensuring judicial review, protecting access to asylum, and challenging abusive federal enforcement practices. He was lead counsel in the ACLU's defense of birthright citizenship resulting in the landmark Trump v. Barbara decision in 2026. He has litigated numerous other cases at all levels of federal and state courts, including blocking state immigration laws, limiting the use of immigration detainers, and curtailing unlawful expedited removal practices. Before his work at the ACLU, Cody was a law clerk to Judge Marsha Berzon of the Ninth Circuit Court of Appeals and Judge Myron Thompson of the U.S. District Court for the Middle District of Alabama. He is a graduate of Yale Law School and the University of California, Santa Cruz.
