What's at Stake

The ACLU Voting Rights Project and the ACLU of Georgia have filed a lawsuit on their own behalf, seeking an injunction allowing them and similar organizations to provide legal representation to elections officials and poll workers. Georgia bars elections officials and poll workers from accepting any donations, services, or other gifts in aid of their duties, and this ban arguably extends to even pro bono legal services. Elections in Georgia, as elsewhere, have prompted extensive litigation and likely will do so in the future. The ACLU and ACLU of Georgia will be ready, including by representing elections officials as necessary.

Many of these suits name elections officials and poll workers as parties or key witnesses.

Since May 2023, Georgia has barred elections officials, registrars, and poll workers from accepting any donation, service, or anything of value in support of their duties. This provision carries criminal penalties.

On May 27, 2026, the ACLU and ACLU of Georgia filed suit, seeking a declaration and injunction allowing them to represent elections officials and poll workers in election-related litigation. The suit argues that, under landmark U.S. Supreme Court precedents, this type of pro bono representation is expressive activity, protected by the federal and Georgia constitutions.
