What's at Stake

The American Civil Liberties Union and the ACLU of Montana filed a federal lawsuit on behalf of two American citizens detained by U.S. Customs and Border Protection for speaking Spanish while shopping at a local convenience store in Havre, Montana.

The lawsuit cites violations of the Fourth Amendment, because there was no legitimate reason to seize the women; and of equal protection, because the agent singled the women out based on race, relying on their use of Spanish as a justification and proxy for race.

The case, Suda v. U.S. Customs and Border Protection, was filed in U.S. District Court in Great Falls, Montana.
