The ACLU submitted these comments in response to a Notice of Proposed Rulemaking from the Department of Health and Human Services (HHS) entitled, ‘Protecting Statutory Conscience Rights in Health Care; Delegations of Authority.’ The Proposed Rule attempts to grant health care providers unprecedented license to refuse to provide information and health care to patients and puts faith before patients’ health. It contravenes HHS’s core mission of protecting and advancing the health of all, and fails to address discrimination that continues to devastate communities, including LGBT individuals, women, and people of color. The comments illustrate how the harms created by the rule would fall most heavily on historically disadvantaged groups and those with limited economic resources, and urge HHS to withdraw the rule.
