What's at Stake

The ACLU and the ACLU of Texas filed a complaint with the U.S. Department of Education Office for Civil Rights on behalf of a high school student who was sent to a disciplinary program after she reported being sexual assaulted by another student.

The Office for Civil Rights issued a decision finding that the student’s school violated Title IX, the federal law prohibiting sex discrimination in schools. OCR concluded that the school had discriminated against the student by relying on the police and failing to independently investigate the assault she reported. OCR also determined that the school had retaliated against her by disciplining her after she reported the assault.
